12.20.010 Intent and purpose.
It is the intent and purpose of this chapter:
A. To allow the holding of tournaments, exhibitions and other special events within city parks and property.
B. To allow overnight parking of recreational vehicles within city parks and property and the occupancy of such recreational vehicles by participants while in attendance at such special event.
C. To establish a procedure to be followed by the sponsoring entity in securing approval to conduct such special events.
D. To provide a mechanism to insure the provision of adequate sanitation, waste removal, and similar services required by the special event and also subsequent cleanup of the areas utilized by the special event. [Ord. 89-1. Code 1988 § 9-7-1].
12.20.020 Special events permitted.
The city council does hereby authorize the use and occupancy of city parks, athletic fields and other city property for the conducting of athletic tournaments, outdoor exhibitions and similar special events, both single- and multi-day, and the temporary occupancy of recreational vehicles parked on the site by persons attending or participating in the approved special event, subject to the issuance of a permit therefor by the city council. 12.20.030 Permit required – Content of application.
Any person or organization desiring to sponsor or conduct a special event utilizing one or more of the city-owned parks or properties shall submit an application and event plan proposal to the city council not less than one month prior to the scheduled date of event. The application shall be submitted by the person or local representative of the organization sponsoring the event and shall contain the following:
A. Name of sponsoring individual or organization and the name of the local representative, if an agency from outside the city.
B. Statement of the purpose of the event and a description of the activities. Also identification of the city park and/or areas to be utilized by the event.
C. Proposed time period of the event.
D. Estimated number of participants/spectators and estimated number of recreational vehicles to be occupied overnight on the premises.
E. Summary of special provisions for sanitation, waste disposal and security for event. Also program for any required site cleanup and trash removal after event.
F. Estimate of need for additional police or other city services. [Ord. 89-1. Code 1988 § 9-7-3].
12.20.040 City council to approve application – May attach conditions.
The city council shall consider the application at a duly called council meeting and may approve the application upon a finding that the site is adequate and appropriate to accommodate the proposed special event and that the event will not place an undue burden upon the city, its resources or its residents.
In granting approval the council may attach such conditions to the permit as are deemed necessary to ensure the safe and healthy conduct of the event and to protect the interests of the neighborhood and the city. [Ord. 89-1. Code 1988 § 9-7-4].
12.20.050 Use fees – Security deposit.
The city may charge a fee for the use of the facilities and for any extended or additional city services required by the special event.
In addition, the city may require a refundable deposit to insure that the sponsoring organization will carry out subsequent cleanup or restoration. [Ord. 89-1. Code 1988 § 9-7-5].
12.20.060 Consistency with zoning ordinance.
For purposes of compliance with the provisions of the development code, the area or areas identified on the permit to be used for placement and overnight occupancy of recreational vehicles shall be considered as an approved recreational vehicle court for the duration of the special event. 12.20.070 Responsibility for compliance – Penalty.
The applicant or the local representative of the sponsoring organization, as applicable, shall be responsible for compliance with the terms of this chapter or the conditions attached to the permit.
Violation of the provisions of this chapter or any condition attached to the issuance of a permit shall be grounds for termination of the permit and shall be punishable as a class C misdemeanor (see HMC 1.30.010). [Ord. 89-1. Code 1988 § 9-7-7].
