13.20.010 Rates and fees – Rules of operation.
A. The city council shall, from time to time by resolution, establish such rates and fees as it deems proper for the electrical service provided by the city. The fees so established shall be assessed and collected as part of the city utility billing system in accordance with the applicable provisions of Chapter 13.05 HMC.
B. The council may, from time to time by resolution, adopt such rules, regulations and operating procedures, not inconsistent with the terms of this chapter, as are necessary for the use, operation and management of the electrical system. [Code 1988 § 9-4-2].
13.20.020 Free access to premises.
The city and their agents shall at all ordinary hours have free access to places supplied with service from the city electrical system to examine the apparatus to ascertain whether the service is being used, the amount of electricity used, and that the manner of use of the service is consistent with city requirements. [Code 1988 § 9-4-3.1].
13.20.030 Requests for electric service.
Requests for electric service shall be processed in accordance with the provisions of HMC 13.05.020 through 13.05.050. [Code 1988 § 9-4-3.2].
13.20.040 Unauthorized use of electric power prohibited – Meter required.
It shall be unlawful for any person to obtain electric power from the city electrical system without receiving proper authorization to do so (see Chapter 13.05 HMC) and having a meter installed.
All structures using electricity from the city electrical system shall have such number of meters connected to their system as are necessary to determine the amount of electricity used and determine charges for electric service. [Code 1988 § 9-4-4.1].
13.20.050 Interference with electrical system prohibited.
Any person who shall intentionally cut, break, injure, or remove any pole, insulator, transmission line, transformer, or other appurtenance of the electrical distribution system, or who shall intercept or attempt to intercept the transmission of electric power, shall be guilty of a violation of this chapter.
Any person who shall intentionally or negligently allow a tree or shrub to grow in such a way as to interfere with a lateral service transmission line or the maintenance of the same shall be guilty of a violation of this chapter.
The chief of police or other designated agent of the city may serve a written notice upon the owner, occupant, or agent of the property containing a tree or shrub which is interfering with a lateral service line, which notice shall require that the interference be abated within a reasonable time. In the case of neglect or refusal to abate the interference, after notice, the city may abate or procure the abatement of the same, and the offending person shall be responsible for the reasonable expenses of such abatement. 13.20.060 Penalty.
A. Violation of this chapter or any rule or regulation adopted pursuant hereto shall be guilty of a class B misdemeanor.
B. In addition to the penalties hereinabove provided, any electrical service user violating any of the provisions of this chapter or any rule or regulation adopted pursuant hereto relating to the electrical system shall forfeit all payments made. Also, the right to the use of electrical service to the premises of such user shall be discontinued. [Code 1988 § 9-4-4.3].
