6.10.010 Definitions.
“Livestock” means cattle, horses, mules, sheep, goats, or hogs.
“Running at large” means strolling about without restraint or confinement, roving or rambling at will.
Nuisance. For purposes of this chapter, the word “nuisance” means the following:
A. The owner or person in possession of a dog or livestock within a three-month period, and on three separate days, allows one of the following:
1. Noise; or
2. Smell; or
3. Trash, rubbish or the accumulation of other unsightly things;
that interferes with the quiet enjoyment of any property or business of another; or
B. The owner or person in possession of a dog within a three-month period, and on three separate days, allows the dog to bark, growl or howl between the hours of 10:00 p.m. and 6:00 a.m. [Ord. 4-17-08 § 1.]
6.10.020 Running at large.
No person who owns or is in possession of livestock shall permit it to run at large within the city limits of Manila City. [Ord. 4-17-08 § 2.]
6.10.030 Liability for damage.
The owner of any livestock that trespasses upon the premises or property of another person is liable in a civil action to the owner or occupant of the premises for any damage afflicted by the trespass. [Ord. 4-17-08 § 3.]
6.10.040 Nuisance.
No person who owns or is in possession of a dog or livestock shall allow the dog or livestock to cause a nuisance within the city limits of Manila. [Ord. 4-17-08 § 5.]
6.10.050 Injuring or killing dogs lawful when.
Any person may injure or kill any dog within the city limits while the dog is attacking, chasing, or worrying:
A. Any person;
B. A domestic animal having a commercial value;
C. Any species of hoofed, protected wildlife; or
D. Domestic fowl. [Ord. 4-17-08 § 6.]
6.10.060 Violation – Penalty.
Any person violating any of the provisions of this chapter shall be deemed guilty of a Class B misdemeanor. In addition to a fine and/or imprisonment of the person violating this chapter, the magistrate may order the removal or destruction of the offending dog or livestock. [Ord. 4-17-08 § 7.]
