Article III. Meetings, Procedure and
Conduct – Voting

2.08.090 Time, place – Exceptions.

A. Pursuant to Section 52-4-02, Utah Code Annotated 1953, the town of Mayfield hereby gives notice that the town council holds its regular meetings on the second Wednesday of each month starting at 7:00 p.m. Mountain Standard Time at the Mayfield Town Hall, located at 52 North Main Street, Mayfield, Utah.

B. If the meeting date is a legal holiday, then the meeting shall be held at the same time and place above described on the next following day which is not a legal holiday.

C. The town council may by resolution provide for a different time and place for holding regular meetings of the town council. [Res. 2018-2019-E; Res. 2016-2017-A; Res. 2014-15-B; Res. 2007-08-E; Res. 1990-1; code 1986 § 3-502.]

2.08.095 Electronic meetings.

A. Definitions. The following terms are defined as follows for the purpose of this section:

1. “Anchor location” means the council chambers at Mayfield Town Hall or such other location designated in the agenda for the meeting.

2. “Meeting administrator” means the town recorder, or another employee of the town specifically assigned and designated to operate the telephonic or electronic conference equipment at the anchor location to assure that all members of the council are continuously able to participate in the meeting and to advise the party conducting the meeting of the initiation, recess, if appropriate, or adjournment of the meeting.

3. “Electronic meeting” means a public meeting of the council convened and conducted by means of a telephonic conference device or other electronic means, allowing each member of the council to call, video conference, or otherwise participate concurrently with all other members of the council in the conduct of the meeting.

B. Notice of Electronic Meetings. The council may convene electronic meetings when necessary. Unless otherwise indicated on the meeting agenda, council members may participate in all meetings electronically. It shall be the responsibility of each council member to contact the meeting administrator prior to the meeting to assure that facilities are set up for the meeting to participate electronically.

C. Quorum Verification. No electronic meeting shall be convened unless a quorum of the council is able to participate either in person or electronically in the meeting.

D. Public Attendance. Each electronic meeting shall be convened by the meeting administrator by announcing the parties present at the meeting and by making available to members of the public at the anchor location an amplified speaker or video monitor enabling members of the public to hear the comments of council members and the conduct of the meeting.

E. Conduct of the Meeting. All meetings shall be conducted by a council member who is physically at the meeting unless all council members are appearing electronically or telephonically. Upon determining that a sufficient number of the council are present for the meeting to be convened and members of the public can adequately hear the comments of all members of the council, the mayor or council member conducting the meeting shall formally convene the meeting and take a roll call of those participating. If a council member is disconnected during the meeting, it shall be within the discretion of the mayor or other council member conducting the meeting to determine whether to continue the meeting without the person or wait until they can be reconnected. The mayor or other council member conducting the meeting may also move agenda items to provide time to try to reconnect.

F. Compliance with Law. In all other respects, electronic or telephonic meetings shall be conducted, recorded, and minutes shall be kept as required by law for all other open and public meetings, or for all other record-keeping purposes of the town. [Res. 2020-2 §§ 1 – 6.]

2.08.170 Records access and management.

A. Short Title. This section is known as the “Mayfield Town Government Records Access and Management Act.”

B. Purpose and Intent.

1. In enacting this section, the town recognizes two fundamental constitutional rights:

a. The right of privacy in relation to personal data gathered by the town; and

b. The public’s right of access to information concerning the conduct of the public’s business.

2. It is the intent of the town to:

a. Establish fair information practices to prevent abuse of personal information by the town while protecting the public’s right of easy and reasonable access to unrestricted public records.

b. Provide guidelines of openness to government information and privacy of personal information consistent with nationwide standards.

c. Establish and maintain an active, continuing program for the economical and efficient management of the town’s records as provided in this section.

C. Applicability of State Law. Government records access and management in Mayfield Town shall be governed by the current version of the Utah Government Records Access and Management Act, as amended. [Res. 2015-16-A §§ 1 – 3.]
