Article I. Residential Development Fee

3.25.010 Purpose.

The continued increase in the development of land in Naples City with the attendant increase in the population of the city has created an urgent need for the planning, acquisitions, improvement and expansion of various public facilities and services to serve the increasing population of the city and for means of providing additional revenues with which to finance such public facilities and services. The city council hereby declares that the fees required to be paid by this chapter are assessed pursuant to these needs created by new development. [Ord. 87-34 § 6-04-001, 1987.]

3.25.020 Fees imposed.

The city council hereby levies a development fee for the expansion of each of the city’s public facilities and services including, but not limited to, police, fire, street construction, parks and recreation and flood control on the privilege of constructing in the city new residential structures. Separate development fees will be established for each municipal service or facility requiring capital improvements as a result of population growth. [Ord. 87-34 § 6-04-002, 1987.]

3.25.030 Amount of fee.

The amount of each development fee to be charged in connection with new development shall be established by resolution of the city council following analysis of projected capital costs of each municipal service. Such analysis of projected costs, as the basis for imposed development fees, shall be presented in public hearing for public comment prior to adoption. [Ord. 87-34 § 6-04-003, 1987.]

3.25.040 Disposition of revenues.

All of the sums collected pursuant to this article shall be deposited in a capital improvement fund to be used solely for capital expenditures for the service function for which the development fee was charged. [Ord. 87-34 § 6-04-004, 1987.]

3.25.050 Time for payment.

Development fees shall be due and payable upon application to Naples City for a building permit for construction of any dwelling unit or units; provided, however, that there shall be a refund in the event the building permit is not approved or is not used for such construction. [Ord. 87-34 § 6-04-005, 1987.]

3.25.060 Credit for deduction.

Upon agreement of the landowner and the city, land for recreational uses or other in-kind contribution to the city’s capital facilities such as construction or upgrading of roadways or other improvements may be dedicated to the city in lieu of the payment of all or part of the development fees otherwise due. The amount of land or other capital participation by the landowner and the amount of credit to be given under this section shall be at the sole discretion of the city council and shall be pursuant to written guidelines to be prepared by the council and available to all persons upon request. Such guidelines shall be adopted by resolution. [Ord. 87-34 § 6-04-006, 1987.]

Article II. Road Development Fee

3.25.070 Purpose.

It is necessary and expedient that the streets and roadways within Naples City be established and maintained. The streets and roads within Naples City are constantly being excavated at the site of new construction to establish utilities and entranceways to new construction. Existing roads in Naples City were not designed or constructed to handle the increased volume of traffic caused by buildings and developments in the city. Construction of new structures imposes additional burdens on the city roads during construction and results in increased traffic volume after completion. It is appropriate and proper that the developers of new construction pay a part of the cost of repair, maintenance, and establishment of the streets and roads within Naples City, which necessitate the additional use and disturbance of existing roadways which result from new structures, all of which have been heretofore borne by the local residents. 3.25.080 Fee levied.

There shall be collected from each person making a cut in any road maintained by Naples City a nonrefundable fee of $165.00. The $165.00 shall be deposited in the street and road capital improvement fund. In extraordinary circumstances or upon good cause, the council may waive any part or all of this fee. 3.25.090 Residential fee.

There shall be collected from each purchaser of a building permit for the construction of a multiple unit residential structure or commercial/industrial structure the sum of $150.00 per unit for payment to and deposit in the street and road capital improvement fund. The fee shall be paid at the time the building permit is procured. [Ord. 87-34 § 6-05-003, 1987.]

3.25.100 Subdivision fee.

There shall be collected from each developer of a major or minor subdivision a fee to be deposited in the street and road capital improvement fund as set forth in the subdivision ordinance. [Ord. 87-34 § 6-05-004, 1987.]

3.25.110 Exceptions.

This part shall not apply to agriculture buildings built or constructed within Naples City, or to additions to existing structures or to structures which replace existing structures, so long as the replacement structure is of the same nature and use as the structure being replaced and will not require additional road cuts nor generate increased traffic. Article III. Park Development Fee

3.25.120 Purpose.

It is desirable and beneficial to the residents of Naples City that public park land be acquired, developed, and maintained for the use of the residents of Naples City and such other persons as may from time to time use park facilities. The city council desires to facilitate the development of such public park facilities. [Ord. 87-34 § 6-06-001, 1987.]

3.25.130 Park fund.

There is hereby created a special fund composed of general fund revenues as appropriated by the Naples City council together with such other revenues as may be acquired by the city through grants, donations, or other purposes for the purpose of acquisition, development, and maintenance of public park land. Funds from this account shall be used to acquire property for development as public park land, to develop said park land for the use of the public, and to maintain said park land and all facilities thereon for the use and enjoyment of the public.
