HAZARDOUS MATERIALS EXPENSE RECOVERY

8.20.010 Definitions.
“Expenses” means actual labor costs of government and volunteer personnel, including workers’ compensation benefits, fringe benefits, administrative overhead, costs of equipment operations, cost of materials, and the cost of any contract labor and materials.
“Hazardous materials emergency” means a sudden and unexpected release of any substance that because of its quantity, concentration, or physical, chemical, or infectious characteristics presents a direct and immediate threat to public safety or the environment and requires immediate action to mitigate the threat. 8.20.020 Expense recovery.
Naples City shall be entitled to recover expenses it may incur in the cleanup of any hazardous materials emergency from the person or entity who owned and/or had control over and/or caused the release of the hazardous material involved in the hazardous materials emergency.
