KALISPEL IMPACT MITIGATION FUND

3.93.010 Fund established.
There is hereby created a special revenue fund to be known as the “Kalispel impact mitigation fund,” as prescribed by the Washington State Auditor’s Office through RCW 43.09.200. (Ord. C-558 § 2, 2003)
3.93.020 Source of funds.
Pursuant to Tribal-State Compact for Class III Gaming between the Kalispel Tribe of Indians and the state of Washington executed by the state on October 20, 1998, and the Tribe on October 22, 1998, the City will receive moneys from the Tribe that are set aside in the “impact mitigation fund.” Distribution procedures have been determined by the Kalispel Impact Mitigation Committee as agreed to in a memorandum of understanding, dated August 25, 2003, a copy of which is filed in the Office of the City Clerk-Treasurer. Distributions received by the City from the Impact Mitigation Fund shall be deposited into the Kalispel impact mitigation fund for uses consistent with this chapter. (Ord. C-558 § 3, 2003)
3.93.030 Use of funds.
Funds deposited and accumulated in the Kalispel impact mitigation fund shall be used for purposes consistent with the Tribal-State Compact as reasonably determined by the City Council. Appropriations from the Kalispel impact mitigation fund shall be as set forth in the annual City budget and as modified pursuant to state law. (Ord. C-558 § 4, 2003)
