2.12.010 Existence—Powers.
The existence of a court to be known and designated as the municipal court of the city of Battle Ground, shall be and is hereby ratified with said court having the jurisdiction and being able to exercise all powers vested in the municipal court by Chapter 3.50 RCW together with such other powers and jurisdiction as are generally conferred upon such court in this state either by common law or by express statute. 2.12.020 Jurisdiction.
The municipal court shall have exclusive jurisdiction over traffic infractions arising under city ordinances and exclusive original criminal jurisdiction of all violations of the city ordinances duly adopted by the city of Battle Ground; and such other jurisdiction as is conferred by RCW 3.50.020 and as it may be amended. 2.12.030 Municipal judge—Appointment.
A municipal judge shall be appointed by the city manager for a term of four years commencing January 1, 2010, with confirmation of the designee by the city council. The person appointed shall be a citizen of the United States of America in the state of Washington and an attorney admitted to the practice of law before the courts within the state of Washington. An appointed municipal judge may be disqualified pursuant to RCW 3.50.045. If the judge vacates the position due to death, disability or resignation, the position shall be filled by the city manager for the remainder of the unexpired term subject to confirmation by city council. 2.12.040 Municipal judge—Salary.
The salary of the municipal judge shall be set by ordinance through the city budget process. In the event that the current presiding judge leaves service during the four-year contract term, the person retained to serve the remaining term shall be compensated as then established by ordinance through a budget amendment. 2.12.050 Judges pro tem—Court commissioner.
The residing municipal court judge may designate one or more persons as judges pro tem or as court commissioner. (Ord. 11-12 § 5, 2011)
2.12.060 State statutes adopted by reference.
Except as may be provided in this chapter, Chapter 3.50 RCW shall be and is hereby adopted by reference as it now exists and may hereafter be amended. (Ord. 11-12 § 6, 2011)
2.12.070 Bailiff authority.
Bailiffs in the course of their duties shall have the authority to perform duties in the enforcement of court security, taking persons into custody as ordered by the judge, escorting persons to and from the courtroom, screening individuals for drugs or weapons, intervening in violent situations to protect the innocent, including the use of necessary and reasonable physical force.
