13.102.010 Definitions.

The following words, when used in this title, shall have the following meanings unless defined differently in another chapter or section, in which case the definitions imposed in such other chapter or section will apply only to that chapter or section, unless the context clearly indicates otherwise:

“City” means the city of Battle Ground, Washington, a municipal corporation created and existing under the laws of the state of Washington.

“Commercial unit” means any building or facility used for any purpose other than dwelling, except industrial.

“Developed” means that condition of real property altered from its natural state by the addition to or construction of such property of impervious ground cover or other manmade physical improvements such that the hydrology of the property or portion thereof is affected.

“Dwelling unit” means one room or a suite of two or more rooms designed for or used by one family or housekeeping unit for living and sleeping purposes and having one kitchen. Each unit shall provide a complete independent living space for one or more persons, including permanent facilities for living, sleeping, eating, cooking and sanitation.

“Equivalent dwelling unit (EDU)” means any residential or nonresidential use which has been found to place a demand on the city’s sewerage system or water system approximately equal to the demand thereon by a single-family dwelling.

“House connection” is defined as the pipe from the meter to the point of use.

“Impervious groundcover” means those hard-surfaced areas either which prevent or retard the entry of water into the soil in the manner that such water entered the soil under natural conditions preexistent to development, or which cause water to run off the surface in greater quantities or at an increased rate of flow than that present under natural conditions preexistent to development, including without limitation such surfaces as rooftops, asphalt or concrete sidewalks, paving, driveways and parking lots, walkways, patio areas, storage areas, and gravel, oiled macadam or other surfaces which similarly affect the natural infiltration or runoff patterns existing prior to development.

“Industrial user” means a nonresidential user of the public sewer which discharges a waste that is distinct from sanitary sewage, resulting in an industrial waste.

“Industrial waste” means any liquid, solid or gaseous material or combination thereof resulting from any process of industry, manufacturing, commercial, food processing, business, agriculture, trade or research, including, but not limited to, development, recovering or processing of natural resources and:

1.    Has a concentration of biochemical oxygen demand (BOD) and suspended solids (SS) in excess of two hundred milligrams per liter per average work day; or

2.    Has a discharge containing cadmium, chromium, copper, lead, zinc, silver or similar toxic substances; or

3.    Is found by the city, State Department of Ecology or United States Environmental Protection Agency to have a significant impact on the wastewater treatment system; or

4.    Has a discharge flow of ten thousand gallons or more per average work day.

“Multiple-family (multifamily) dwelling” means a building or portion thereof designed or used as a residence two or more families and containing two or more dwelling units.

“Plan” means the storm drainage utility plan created by Section 3 of Ordinance No. 467 of the city, passed by the city council on November 1, 1982.

“Service connection” is defined as the pipe, meter and water facilities from the city main or branch line to the outlet side of the meter.

“Single-family dwelling” means a building designed or used for residential purposes by not more than one family and containing one dwelling unit only, including mobile homes when not located in a mobile home park and including condominium units subject to fee simple ownership, and excluding multiple-family dwellings, apartments and motels.

“System” means the entire system of storm drainage facilities owned by the utility or over which the utility has control or right of use for the movement and retention of storm and surface waters, including both naturally occurring and manmade facilities.
