16.15.010 Purpose.

The purpose of this chapter is to protect wetlands in a manner consistent with and as required by the Growth Management Act of 1990. The town of Beaux Arts Village recognizes the importance of protecting and preserving significant wetlands and wetland systems. It incorporates by reference the findings of WAC 365-190-800(1). 16.15.020 Definitions.

For purposes of this chapter, “wetlands” shall mean those lands which meet the criteria for wetlands established in the King County sensitive area ordinance. [Ord. 233 § 2, 1992]

16.15.030 Procedure.

(1) Based on current information and survey of Beaux Arts Village, there are no wetlands in the 50 acres of its jurisdiction. However, if new data or other information demonstrates that it is likely, in the opinion of the town building official, that a wetland of 1,000 square feet or larger exists, then no permit for any activity on that property that could possible impact the potential wetland shall be issued without a special study. The study shall be done by an expert recognized by King County at the applicant’s expense. The study shall define the perimeters of the wetland according to the four-tier rating system as adopted by the Washington Department of Ecology. The study shall also indicate the impacts of the proposed activity and if it is a type permitted under the DOE model ordinance, a copy of the study shall be filed with the town clerk.

(2) Any permit granted shall be in accord with the standards provided in Section 7 of the DOE model ordinance after a notice and hearing not less than 15 days after the report has been filed with the town clerk. [Ord. 233 § 3, 1992]

16.15.040 Relationship to the shoreline management ordinance.

All lands within 200 feet of the ordinary high water mark shall continue to be governed by Chapter 16.10 BAVMC, Shoreline Management. [Ord. 233 § 4, 1992]
