CRIMES INVOLVING MOTOR VEHICLES

9.10.010 Unauthorized use of a motor vehicle.

A. A person is guilty of unauthorized use of a motor vehicle when:

1. Having custody of a motor vehicle pursuant to an agreement between himself/herself or another and the owner thereof whereby he/she or another is to perform for compensation a specific service for the owner involving the maintenance, repair or use or storage of such vehicle, he/she intentionally uses or operates the same, without the consent of the owner, for his/her own purposes in a manner constituting a gross deviation from the agreed purpose.

2. Having custody of a motor vehicle pursuant to an agreement between himself/herself or another and the owner thereof whereby the motor vehicle was to be used for an agreed purpose, he/she intentionally uses or operates the same, without the consent of the owner, for his/her own purposes in a manner constituting a gross deviation from the agreed purpose.

B. Unauthorized use of a motor vehicle is a misdemeanor. (Ord. 1444 § 1, 2012).

9.10.020 Altered motor vehicle serial numbers.

Whoever knowingly buys, sells, receives, disposes of, conceals, or has knowingly in his possession any vehicle, watercraft, camper, or component part thereof from which the manufacturer’s serial number or any other distinguishing number or identification mark has been removed, defaced, covered, altered, or destroyed for the purpose of concealment or misrepresenting the identity of the said vehicle, watercraft, camper, or component part thereof shall be guilty of a gross misdemeanor. 9.10.030 Vehicle trespass.

A. A person is guilty of vehicle trespass if they knowingly enter or remain unlawfully in a vehicle that belongs to another.

B. As used in this section:

1. The word “enter” shall include the entrance of the person, or the insertion of any part of their body, or any instrument or weapon held in their hand.

2. A person enters or remains unlawfully in or upon a vehicle when they are not licensed, invited, or otherwise privileged to so enter or remain.

C. Vehicle trespass under this section is a gross misdemeanor, punishable by up to 364 days in jail and up to a $5,000 fine, or by both such fine and imprisonment. (Ord. 1723 § 1, 2024).
