5.16.010 License—Required.
It is unlawful for the owner or lessee of any building or premises in the town to use, rent or to permit the use of any hall, auditorium, theater or other building or premises for the purpose of any public entertainment, show, amusement or exhibition, where an admission fee or other fee or charge is collected from persons witnessing or participating in the same, except upon the obtaining a license from the town clerk therefor, as provided in this chapter. 5.16.020 License—Fees—Payment requirements.
A. The license rate or fees provided to be charged for a license under this chapter for the use of any hall, theater, auditorium, building or other premises for any public entertainment, show, amusement, or exhibition shall be as follows:
1. For one day: two dollars;
2. For three days: five dollars;
3. For one week: seven dollars fifty cents;
4. For one month: ten dollars;
5. For three months: fifteen dollars;
6. For six months: twenty dollars; and
7. For one year: twenty-five dollars.
B. Such license fees or charges shall be paid by the owner or lessee of such hall, building or other premises; provided, that nothing contained in this chapter shall be construed to prevent or prohibit the owner or lessee of such hall, building or premises from collecting such license fees from the persons or parties giving such performance or exhibition. 5.16.030 Applicability of license requirements—Exemptions.
It is unlawful for any person, company or corporation to give any public entertainment, show, amusement or exhibition as provided in this chapter within the town unless a license has first been issued to the owner or lessee of such hall, building or other premises in which or on which such performances or exhibition is to be given; provided, that this chapter shall not be construed to include or to require the payment of any license fees on account of the use of any hall, building or premises for any dance, or for any entertainment or play by a purely local talent company, or for games or contests participated in by local athletic teams. Such exception shall not be construed to exempt the payment of license fees on account of the use of any hall, building or premises for moving picture shows. (Ord. 50 § 3, 1914)
5.16.040 Violation—Penalty—Additional remedies.
Any person who violates the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof may be fined in any sum not exceeding ninety-nine dollars and in default in the payment of such fine and costs or any portion thereof shall be imprisoned in the jail one day for each three dollars of such fine and costs not paid. The amount of any license fees due and payable under this chapter may also be recovered in a civil action brought for such purpose in the name of the town in the municipal court of the town against the parties liable therefor.
