1.08.010 Adoption.

There is adopted for the city the classification of noncharter code city while retaining, pursuant to RCW 35A.02.030, the mayor-council plan of government which is authorized by Chapter 35.24 RCW, now recodified as Chapter 35.23 RCW, under which the city is presently operated, as provided in Chapter 35A.12 RCW, endowed with all the applicable rights, powers, privileges, duties and obligations of a noncharter code city as the same now exists, or may be provided hereafter, including any and all supplements, amendments or other modifications of said title hereafter at any time enacted. (Ord. 365 § 1(Exh. 1.08.020 Effective date.

The city clerk is authorized and directed to forward to the Secretary of State a certified copy of Ordinance No. 64 codified in this chapter for filing pursuant to RCW 35A.02.030 and upon said filing the city shall thereafter be classified as a noncharter code city retaining the mayor-council plan of government authorized by Chapter 35.24 RCW, now recodified as Chapter 35.23 RCW, and shall in all matters other than the structure of city officials, the terms of said offices, and the election thereof be governed by the provisions of RCW Title 35A. (Ord. 365 § 1(Exh. 1.08.030 Terms of office – Filling of vacancies.

The offices of all elected officials shall continue as existing as of the date of passage of Ordinance No. 64, codified in this section, for all positions currently in existence and persons filling those positions shall be unaffected by Ordinance No. 64. The office of all elected city officials, and vacancies occurring in any elective office shall be governed by the provisions of Chapter 35A.12 RCW, the noncharter code city provisions of the optional municipal code. (Ord. 365 § 1(Exh. 1.08.040 Effect on existing ordinances, resolutions and orders.

The ordinances, resolutions and orders adopted under the existing third-class city classification, where not in conflict with state law, shall continue in force until repealed or amended by the city council. (Ord. 365 § 1(Exh. A)(part), 2009: Ord. 64 § 4, 1979)
