The following statutes of the state of Washington are hereby adopted by reference as they now exist or hereafter may be modified:

9.76.020 Stun guns, tasers and similar devices.
A. Possession, Sale or Use Prohibited. It shall be unlawful for any individual, person, firm, corporation, or other entity to sell, give, lend, rent, or otherwise transfer to any other individual, person, firm, corporation, or similar entity an electroshock weapon within the Burlington city limits. For the purposes of this section, an “electroshock weapon” means a device that uses electrical current to disrupt voluntary control of muscles to cause neuromuscular incapacitation, and which delivers such electrical current through electrodes affixed to a dart propelled by compressed air or similar means, and shall include those devices referred to as “projectile stun gun” by RCW 9.41.280.
B. It shall be unlawful for a person to carry onto, or to possess on, public or private elementary or secondary school premises, school-provided transportation, or areas of facilities while being used exclusively by public or private schools a stun gun, taser, or similar weapon, all in accordance with RCW 9.41.280.
C. Exceptions. This section shall not apply to any member of the Burlington police department, any other authorized law enforcement or corrections officer while in the performance of his or her official duties, any member of the armed services while in the performance of his or her official duties, or to any electronic or energy device or weapon designed solely and exclusively for animal control purposes.
D. Penalties. Any violation of this section is a misdemeanor. (Ord. 1768 § 1, 2012; Ord. 1603 § 1, 2006).
