TRESPASS AND RESTRICTED USE OF PUBLIC PROPERTY

10.44.010 Restricted use of public property.
A. It is unlawful for a person or persons to operate, drive or utilize a motor vehicle, including but not limited to motorcycles, all-terrain vehicles (ATVs), “four-wheelers,” motorized scooters, motorized go-carts, and other motorized devices, in an area and upon the Cowlitz River levee easterly of the Cowlitz River, the area to be designated by appropriate signage, or upon the riverfront trail, or any publicly owned or controlled property, or rights-of-way not designated for motor vehicle travel.
B. Violation of this provision will constitute a civil infraction and shall be punishable as such in the Castle Rock municipal court system.
C. The penalty for violation of this section shall be a fine as established by the Rules of the Court, monetary penalty schedule – IRLJ 6.2.
D. The officer issuing the infraction for offense of this chapter has the authority to impound the motor vehicle under any of the following circumstances:
1. That the operation of the vehicle evinced reckless or negligent disregard for the safety of the operator and/or other persons, animals or property;
2. That the motor vehicle operated had previously been operated within the restricted area described in this chapter; and/or
3. The motor vehicle was operated by a person under the age of 18. [Ord. 2007-03 § 4, 2007; Ord. 2002-06 §§ 2 – 5, 2002].
