13.04.010 Title.

This chapter shall be known and may be cited as the Castle Rock combined water and sewer utility ordinance. [Ord. 88-5 § 1, 1988].

13.04.020 Purpose.

It is the purpose of this chapter to consolidate water and sewer utilities under the utilities division of the department of public works for the purpose of administration, construction, operation and financing. [Ord. 88-5 § 2, 1988].

13.04.030 Definitions.

The following definitions shall apply in the interpretation and enforcement of this chapter and the codes adopted herein:

“Agent” means any person who has the care, custody, control or management of any premises or building, or who has control of the renting thereof or the collection of rentals therefrom, and shall, for the purpose of this chapter, be deemed to be the agent of the owner of such premises or building, and the giving of all notices provided for in this chapter to said agent shall be deemed due notice to said owner.

“Apartment” means any single-dwelling unit designed for occupancy in the same building with other dwelling units and having separate kitchen facilities in each unit.

“BOD” (denoting biochemical oxygen demand) means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20 degrees centigrade, expressed in parts per million by weight.

“Building drain” means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste, and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning three feet outside the inner face of the building wall.

“County health officer” means the official responsible for the public health, or his authorized representative.

“Garbage” means solid wastes from the preparation, cooking and dispensing of food, and from the handling, storage and sale of produce.

“Industrial wastes” means the liquid wastes from industrial processes as distinct from sanitary sewer.

“Permit” means an application approved by the public works director prior to construction of a private utility system or uncovering, making connection with or opening into, using, altering or disturbing any public utility system.

“Person” means an individual, partnership, corporation, association, unincorporated organization, trust or other legal or commercial entity, including a joint venture. The word “person” shall also include the state or local government.

“pH” means the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.

“Private sewer” means the sewer line and disposal system constructed, installed or maintained where connection with the public sewer system is not required herein.

“Private utility” means the water or sewer system constructed, installed or maintained where connection with the public water or sewer system is not required herein.

“Properly shredded garbage” means the wastes from the preparation, cooking and dispensing of foods that have been shredded to such degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half inch in any dimension.

“Property owner” means the fee owner, except that with respect to property being sold under a real estate contract it shall mean the contract purchaser, and with respect to property subject to deed of trust it means the grantor.

“Public sewer” means any sanitary sewers, including, but not limited to, trunks, laterals, stubs and force mains, and being constructed by the city or any conveyed to the city and lying within the right-of-way or a perpetual easement obtained or granted to the city.

“Public works director” means the public works director of the city or his authorized deputy, agent or representative.

“Sanitary sewage” means the combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, which wastes contain polluted matter subject to treatment at the sewage treatment plant.

“Sanitary sewer” means a pipe or conduct for carrying sewerage.

“Side sewer” means a sanitary sewer pipe leading from a plumbing outlet, drain or other facility to the stub sewer of the public sewer system.

“Stub” means a sewer line constructed from the public sewer system to the property line or edge of perpetual easement on the property being served.

“Suspended solids” means solids that either float on the surface of or are in suspension in water, sewage or other liquids, and which are removable by filtering.

“Wastewater” means the spent water of a community. From the standing source it may be a combination of the liquid and water-carried wastes from residences, commercial buildings, industrial plants and institutions. [Ord. 88-5 § 3, 1988].
