10.40.010 Definitions.
As used in this chapter, the definitions indicated below shall apply:
A. “Watercraft” means any floating or submersible boat, canoe, skiff, raft, or other device.
B. “Motorized” means propelled by any internal combustion engine, electric motor, or sail which is fueled by gas, diesel, kerosene, benzene, steam, hydrogen, ether, electricity, wind, or any other liquid or solid substance or fuel which provides propulsion for moving an object on, through or under water.
C. “Operator” means a person who is in control of, in charge of, a watercraft vessel while it is in use.
D. “Person” means an individual, firm, partnership, agency, organization, company, association or other legal entity. (Ord. 1840 § 1 (part), 1995).
10.40.020 Unlawful uses and actions.
A. From and after the effective date of the ordinance codified in this chapter it shall be unlawful for any person or operator to operate any motorized watercraft in or upon the waters of Plummer Lake that is equipped with an engine or motor exceeding three and one-half horsepower.
B. From and after the effective date of the ordinance codified in this chapter it shall be unlawful for any person or operator to operate any watercraft, motorized or nonmotorized, in or upon the waters of Plummer Lake at a speed exceeding five miles per hour.
C. Littering. It shall be unlawful for any person or operator to throw or leave any garbage or refuse in the lake, on lake banks, lake shoreline, or boat launch area or surrounding properties. (Ord. 1840 § 1 (part), 1995).
10.40.030 Manner of operations—Basic rules.
A. Every person or operator operating watercraft on Plummer Lake shall operate the same in a careful and prudent manner.
B. Hours of Operation. The operation and use of motorized watercraft on Plummer Lake by any person or operator is prohibited from the period between one-half hour after sunset and one-half hour before sunrise.
C. Equipment. All watercraft operating on Plummer Lake must have on board at least one Coast Guard approved flotation device (AFD) for each person on board. (Ord. 1840 § 1 (part), 1995).
10.40.040 Penalty for violation.
Any person violating this chapter shall be deemed guilty of a misdemeanor. (Ord. 1840 § 1 (part), 1995).
