TRAFFIC SAFETY ENHANCEMENT PROGRAM

9.03.010 Traffic safety enhancement program.

(1)    The traffic safety enhancement program is established for the purpose of promoting public safety on county roads within unincorporated Chelan County by providing enhancement to funding for enforcement of laws, resolutions, code, regulations and policies pertaining to the county roads.

(2)    The county sheriff and the board of county commissioners may enter an agreement establishing a program for traffic safety enhancement for county roads in furtherance of the purposes of this chapter. (Res. 2013-09 (Exh. A) (part), 1/15/13).

9.03.020 Traffic safety enhancement fund.

(1)    The traffic safety enhancement fund is established as a special fund, and the county auditor and the county treasurer shall establish such fund in their respective offices. The fund shall not lapse.

(2)    The traffic safety enhancement fund shall be composed of:

(A)    Initial funding from the county road fund;

(B)    Gifts;

(C)    Fines, forfeitures, and penalties for violations of county code or state law assessed and collected because of arrests by or citations issued by sheriff’s deputies assigned to the traffic safety enhancement program and received by the county treasurer as provided in RCW 3.62.020(3), as now or hereafter amended, and which shall thereafter be transferred at least monthly from the county current expense fund to the traffic safety enhancement fund; and

(D)    Appropriations to the traffic safety enhancement fund by Chelan County, state or federal sources, or any combination thereof.

(3)    The traffic safety enhancement fund shall be administered by the county engineer. The traffic safety enhancement fund may be used for the following county road and traffic policing purposes:

(A)    Speed enforcement and accident investigation;

(B)    Reducing unsafe road and right-of-way conditions;

(C)    Removing abandoned vehicles from the county road and right-of-way;

(D)    Removing roadway and right-of-way obstructions;

(E)    Illegal littering and dumping on county right-of-way;

(F)    Oversize/overlegal vehicle (weight, length, width and height) violations;

(G)    Sign damage investigation and enforcement;

(H)    Road condition enforcement, including mud, water, and detritus spills;

(I)    Right-of-way encroachment investigation and encroachment enforcement;

(J)    Maintenance and construction zone traffic control;

(K)    County vehicle accident investigation; and

(L)    Other activities clearly related to county road law enforcement needs.

(4)    Money shall be disbursed from the traffic safety enhancement fund pursuant to the agreement between the board of county commissioners and the county sheriff. (Res. 2013-09 (Exh. A) (part), 1/15/13).
