9.12.015 Temporary parking restrictions during road construction, emergency conditions, or events in the right-of-way.

(a)    Parking is temporarily restricted or prohibited on county right-of-way as set forth in this section during road construction, emergency conditions, or events permitted or exempt under Chapter 9.26.

(b)    The county engineer may temporarily restrict or prohibit parking on any county right-of-way during road construction, emergency conditions, or events permitted or exempt under Chapter 9.26; provided, that notice of the parking restriction or prohibition for road construction or events are conspicuously posted at each restriction or prohibition area at least twenty-four hours prior to being effective. Emergency parking restrictions or prohibitions may be summarily implemented. All temporary parking regulation signs installed in accordance with this section shall conform to the Manual on Uniform Traffic Control Devices for streets and highways for the state of Washington.

(c)    The owner or operator of any vehicle who knowingly parks the vehicle in county right-of-way in violation of a parking restriction or prohibition under this section shall be guilty of a misdemeanor; except, the owner or operator of a vehicle parked in county right-of-way prior to imposition of an emergency parking restriction or prohibition shall only be guilty of a misdemeanor if the county road is open to public travel and the vehicle remains parked in the restricted or prohibited area for more than eight hours after the temporary regulation signs are installed.

(d)    Every person convicted of a violation of this section shall be punished by imprisonment in the county jail for a maximum term fixed by the court of not more than ninety days, or by a fine in an amount fixed by the court of not more than one hundred dollars, exclusive of statutory PSEA assessments, or by both such imprisonment and fine.

(e)    The county sheriff shall provide for the removal or impounding, at the owner’s or operator’s expense, of any vehicle parked in violation of the restrictions or prohibitions of this section. (Res. 2015-44 (Exh. A), 4/7/15).

9.12.020 Authority to establish no-parking zones on right-of-way.

The board of Chelan County commissioners may, by resolution, establish no-parking zones on any portion of the right-of-way of any county road where such parking would constitute a public health and safety concern to the public. Such zones shall be marked by properly erected and maintained “NO PARKING” signs. (Res. 2023-71 § 1, 7/25/23; Res. 479-D § 1, September 5, 1961 at Vol. B page 455).

9.12.030 Penalty for parking in no-parking zone.

Parking any vehicle in any no-parking zone properly marked by “NO PARKING” signs shall constitute a traffic infraction punishable by a fine of one hundred dollars. In the event that the initial fine is not paid within the first fifteen days following the date of issuance of the citation for such infraction, the fine shall increase to one hundred fifty dollars. 9.12.040 Courthouse area parking regulations.

(a)    The regulations set forth in this section shall govern parking of vehicles upon the parking areas owned by Chelan County in the immediate vicinity of the Chelan County Courthouse, herein referred to as “courthouse parking areas,” being situated upon the following described real property:

Lots 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28 and 29, Block 15; and Lots 11, 12, 13, 14, 15, 16, 17, 18, 19, 20 and 21; and Lots 40, 41, 42 and 43, Block 16; and Lots 1, 2, 3, 4, 5 and the west half of Lot 24, Block 25; and Lots 33, 34, 35, 36, 37 and 38, Block 21, of the Great Northern Amended Plat of Wenatchee, Chelan County, Washington.

(b)    Parking stalls specifically labeled for particular office holders or departments shall be occupied only by the vehicles of the specified office holders or departments.

(c)    Parking areas specifically labeled for designated purposes or designated classes of persons, such as “loading zone,” “courthouse patrons,” “county employees,” or “library patrons,” shall be occupied only for the designated purpose or by the vehicles of members of the designated class while engaged in the described function or activity and/or for the time limits specifically set forth.

(d)    No vehicles shall be or remain parked in courthouse parking areas other than vehicles of the Chelan County sheriff’s office, or other law enforcement agencies while on official business, between the hours of midnight and six a.m. or during other periods when parking is posted as prohibited.

(e)    Clearly conspicuous signs shall mark all parking restrictions and designations and shall give notice:

(1)    That unauthorized vehicles will be removed at owner’s expense;

(2)    Of the name, telephone number, and location of the towing firm authorized to remove vehicles.

(f)    Vehicles parked contrary to this section shall be towed away and stored at owner’s expense at the location described on the posted signs.

(g)    Vehicles parked in violation of the provisions of this section with respect to limited time parking are also subject to enforcement and citation by the city of Wenatchee under WCC 6B.06.100(1)(j) and interlocal agreement with Chelan County (Resolution No. 2007-135).
