2.51.190 Planning commission authority to act as hearings examiner.

(1)    Except as provided for in subsection (2) of this section, a planning commission decision on those matters delegated to it by Section 2.51.090(2) shall have the same effect as the decision of the examiner.

(2)    Planning commission decisions on rezone or preliminary plat applications shall constitute a recommendation to the board; provided, that if, after considering the matter at public meeting, the board deems a change in the planning commission’s recommendation to be necessary, such change shall not be made until the board shall conduct its own public hearing, giving notice thereof as required by law.
