5.45.150 Exterior and sign regulations.
(1) Exterior Regulations.
(a) Visual Access. No license shall be issued or continued for an adult entertainment enterprise, if the merchandise or activities of the adult entertainment enterprise are visible from any point outside such enterprise.
(b) Exterior Decor. No license shall be issued or continued for an adult entertainment enterprise, if the exterior portions of such enterprise have flashing lights, or any words, lettering, photographs, silhouettes, drawings or pictorial representations of any manner except to the extent permitted by the provisions of this chapter.
(2) Sign Regulations.
(a) Sign Restrictions. Notwithstanding 40.310 of this code or any other ordinance or regulation to the contrary, no license shall be issued or continued for an adult entertainment establishment displaying more than one (1) primary sign and one (1) secondary sign as provided herein.
(b) Primary Signs. Primary signs shall have no more than two (2) display surfaces. Each such display surface shall:
(i) Not contain any flashing lights;
(ii) Be a flat plane, rectangular in shape;
(iii) Not exceed seventy-five (75) square feet in area; and
(iv) Not exceed ten (10) feet in height or ten (10) feet in length.
Primary signs shall contain no photographs, silhouettes, drawings or pictorial representations of any manner, and may contain only the name of the adult entertainment establishment and one or more of the defined adult uses, set forth in Section 5.45.020(1). In the case of adult movie theaters, primary signs shall not contain movie titles, but the same shall be displayed only in the interior portion of such adult theater.
(c) Secondary Signs. Secondary signs shall have only one (1) display surface. Such display surface shall:
(i) Be a flat plane, rectangular in shape;
(ii) Not exceed twenty (20) square feet in area;
(iii) Not exceed five (5) feet in height and four (4) feet in width; and
(iv) Be affixed or attached to an exterior wall or door of the establishment.
All provisions of subsection (2)(b) of this section shall be applicable to secondary signs. (Sec. 5 of Ord. 1990-08-03)
