5.60.115 Public duty not created.
A. It is expressly the purpose of the ordinance codified in this chapter to provide for and promote the health, safety and welfare of the general public and not to create or otherwise establish or designate any particular class or group of persons or individual who will or should be especially protected or benefited by the terms of the ordinance codified in this chapter.
B. Registration of an alarm system is not intended to, nor will it, create a contract, duty or obligation, either expressed or implied, of response. Any and all liability and consequential damage resulting from the failure to respond to a notification is hereby disclaimed and governmental immunity as provided by law is retained. By registering an alarm system, the alarm user acknowledges that police response may be based on factors such as: availability of police units, priority of call, weather conditions, traffic conditions, emergency conditions staffing levels and prior response history.
