9.34.010 Cruising.

A.    It is a traffic infraction for any person to drive, or to permit a motor vehicle under his/her care, custody or control to be driven, past a traffic control point more than two (2) times in the same direction of travel within a two (2) hour period in or around a posted no-cruising area so as to contribute to traffic congestion, obstruction of streets, sidewalks or parking lots, impediment of access to shopping centers or other buildings open to the public, or interference with the use of property or conduct of business in the area adjacent thereto.

B.    “Traffic control point” as used in this section means any point or points within the no-cruising area established by the sheriff’s office for the purpose of monitoring cruising.

C.    No area shall be designated or posted as a no-cruising area except upon passage of a resolution by the Clark County board of county commissioners specifically mandating such designation and posting for a particular area.

This section shall not apply to in-service emergency vehicles, taxicabs for hire, buses, and other vehicles being driven for business purposes.

D.    The Clark County sheriff or his designee shall determine when an area has become so congested by traffic as to present a danger of traffic congestion, obstruction of streets, sidewalks or parking lots, impediment of access to shopping centers or other buildings open to the public, or interference with the use of property or conduct of business in the area adjacent thereto, or that emergency vehicles cannot respond in that area within a reasonable period of time.

E.    The sheriff or his designee shall then direct that no-cruising signs shall be erected. No person, without lawful authority to do so, shall remove, damage, obstruct or in any way interfere with such posted signs.

F.    No violation shall occur except upon the third passage by the same traffic control point.

G.    The provisions of this chapter are applicable during the period from 8:00 P.M. through 4:00 A.M. (Sec. 1 of Ord. 1993-07-23)
