13.26A.060 Hazards.
A. Whenever the responsible official determines that any violation of this chapter poses a hazard to public health, safety or welfare; endangers any property; or adversely affects the safety and operation of county right-of-way, utilities and/or other property owned or maintained by the county; the person holding title to the subject property, and/or other person or agent in control of such property, upon receipt of notice in writing from the responsible official, shall within the period specified therein address the cause of the hazardous situation in conformance with the requirements of this chapter.
B. Notwithstanding any other provisions of this chapter, whenever it appears to the responsible official that conditions covered by this chapter exist and necessitate immediate action to protect the public health and/or safety, the responsible official is authorized to enter such property, as provided by Chapter 32.04, for the purpose of inspecting and investigating such emergency conditions. The responsible official may without prior notice order the immediate discontinuance of any activity leading to the emergency condition. Failure to comply with such order shall constitute a misdemeanor as specified in Title 32. (Exh. A of Ord. 1998-11-17; amended by Sec. 3 (Exh.
