13.30A.050 Rate structure and fees.

(1)    Stormwater service charges shall be calculated based upon the contribution of stormwater runoff from developed parcels within the unincorporated areas of Clark County using the Land Use Categories shown in Table 1. Land use categories include single-family residential small lots, single-family residential large lots, multifamily residential lots, and nonresidential lots.

Stormwater services for nonresidential lots shall be calculated by determining the number of equivalent residential units (ERU), also referred to as base units, on the property. The base unit is three thousand five hundred (3,500) square feet of impervious surface area, which represents a typical amount of impervious surface area for a single-family residential lot within the county’s urban growth area. The final number of base units assessed to a nonresidential property considers the total impervious surface area on the lot, divided by the base unit of three thousand five hundred (3,500) square feet, to establish a service charge proportionate to the property’s stormwater runoff contribution, relative to residential properties. Stormwater service charges for residential properties shall be determined based upon the size of the single-family residential lot and the total number of dwellings on multifamily lots.

(a)    Single-family residential small lots, one-half (1/2) acre or less, shall be charged a stormwater rate as set forth in Table 1, regardless of actual measured impervious square footage.

(b)    Larger single-family residential lots, greater than one-half (1/2) acre in size, shall be charged a reduced stormwater rate as set forth in Table 1.

(c)    Single-family residential lots with more than one (1) residential dwelling shall be categorized as multifamily residential lots regardless of the parcel’s zoning.

(d)    The service charge for multifamily lots shall be charged a reduced stormwater rate as set forth in Table 1 based on the number of residential dwellings located on the lot.

(e)    Service charges for state highways are governed by RCW 90.03.525 and shall not be assessed without an approved plan for expenditure of the fees in accordance with RCW 90.03.525.

(2)    Service charges shall be as defined in Table 1.
