36.04A.155 PEG access capital support fund.

In the event that a cable franchisee makes capital contributions to support public, educational governmental cable access, or for the provision of a public institutional network, then those funds shall be deposited into a separate fund and disbursements shall be made only for those purposes.

The capital contribution fund may be held and administered by the city of Vancouver under the terms of an interlocal agreement. Such an agreement shall provide that the franchisee is to make remittances directly to the city; the franchisee and the city are to keep a record of contributions made for or on behalf of subscribers within the unincorporated area of the county; disbursements will not be made without the report of the cable commission and the approval of both the city council and board of county commissioners; and that upon termination of the interlocal agreement, the contributions held shall be distributed to the county and the city in the same proportion as they were collected from subscribers in each jurisdiction.
