9.16.010 Fireworks law adopted by reference.
The state fireworks law, Chapter 70.77 RCW, is adopted by reference as and for the fireworks ordinance of this city as if set forth in full in this chapter, together with all future amendments and revisions to that law, except as otherwise provided or limited by the provisions of this chapter. 9.16.020 Fire marshal rules adopted by reference.
The rules and regulations of the State Fire Marshal, as authorized by RCW 70.77.250, which are necessary to carry out the provisions of the state fireworks law, are adopted by reference, together with all future amendments and revisions to those rules and regulations. 9.16.025 Emergencies – Restrictions on use.
The mayor, after consulting with the fire chief and other officials as may be deemed appropriate, may prohibit the discharge of all fireworks during periods of extreme fire danger. For purposes of this chapter, the term “extreme fire danger” shall mean a condition of extraordinary fire hazard as designated by the city of Clarkston fire chief. [Ord. 1654 § 1, 2021.]
9.16.030 Discharge of consumer fireworks – Days and hours permitted.
(1) Except as permitted by this chapter and state law, it is unlawful to possess, discharge or sell at wholesale or retail any fireworks other than consumer fireworks.
(2) No consumer fireworks shall be sold or offered for sale at retail within the city except as permitted in RCW 70.77.395.
(3) It is unlawful for a person to ignite, discharge, or use any consumer fireworks except between the hours of 9:00 a.m. on July 4th and 12:01 a.m. on July 5th, and from 6:00 p.m. on December 31st and 1:00 a.m. on January 1st.
(4) Consumer fireworks may not be discharged within the city of Clarkston at any other time.
(5) It is unlawful for any person to discharge fireworks on the property of another without permission of the owner of such property. It is unlawful for any person to discharge fireworks on city property without the express written permission of the city council.
(6) This section shall take precedence over and shall preempt any conflicting provision of the Revised Code of Washington or the Washington Administrative Code. [Ord. 1655 § 1, 2021; Ord. 1631 § 1, 2019; Ord. 1566 § 1, 2016; Ord. 1521 § 1, 2014.]
9.16.040 Penalty.
Any person convicted of a violation of this chapter shall be guilty of a misdemeanor and shall be punished by a fine not to exceed $1,000 or by imprisonment in jail for a period not to exceed 90 days, or by both such fine and imprisonment. [Ord. 1521 § 1, 2014.]
