5.04.040 Peddling without a license prohibited.
5.04.010 Peddler defined.
The term “peddler” as used in this chapter means and includes any person, either principal or agent, who:
A. Sells, or offers for sale, goods, wares, merchandise or other commodities by outcry or otherwise, on the streets, alleys, or other places within the city;
B. Goes from house to house or place to place within the city, selling or offering same for sale at retail to individuals, not dealers, therein, whether such goods, wares or merchandise or other commodities be carried along for delivery presently, or whether the sales are made for future delivery; or
C. For the purpose of carrying on temporary or transient business, hires, leases or occupies a building, structure, tent, car, vehicle, storeroom or place of any kind for the exhibition or sale of any goods, wares, merchandise or other commodities. (Ord. 1624 NS § 1, 2018; prior code § 3.12.010).
5.04.020 License required.
A. Any person seeking to engage in business as a peddler shall first obtain a peddler’s license from the city, as provided for in this chapter.
B. Every peddler shall be required to carry the peddler’s license and display it along with photo identification upon request by a prospective customer or law enforcement officer.
C. The peddler’s license required under this chapter is separate from and in addition to the business license issued under Chapter 5.02 CMC, which may also be required when applicable. (Ord. 1669 NS § 1, 2020; Ord. 1624 NS § 1, 2018).
5.04.030 Fees and renewal.
A. Peddler licenses shall be valid through December 31st of the year for which they are issued.
B. The annual license fee shall be $20.00 for peddlers. (Ord. 1624 NS § 1, 2018).
5.04.040 Peddling without a license prohibited.
It is unlawful for any person, company or corporation to act as a peddler as defined in this chapter within the city limits without having first obtained a peddler’s license therefor as provided in this chapter. (Ord. 1624 NS § 1, 2018; prior code § 3.12.030. Formerly 5.04.030).
5.04.050 Violation – Penalty.
Any person, firm, company, corporation or association of persons violating the provisions of this chapter shall be deemed guilty of a misdemeanor punishable as set forth in CMC 1.08.010. (Ord. 1624 NS § 1, 2018; prior code § 3.12.070. Formerly 5.04.060).
