10.08.010 Speed regulations.

A. Every person operating or driving a vehicle of any character upon the streets, alleys or ways open to public travel shall operate the same in a careful and prudent manner and at a rate of speed no greater than is reasonable and proper under the conditions existing at the point of operation, taking into account the amount and character of the traffic, weight of vehicle, grade and width of roadway, condition of surface and freedom of obstruction to view ahead and consistent with any and all conditions existing at the point of operation, so as not to unduly or unreasonably endanger the life, limb, property or other rights of any person entitled to the use of such streets, alleys, or ways, or of any child or children of immature years upon or adjacent to the same.

B. Subject to the provisions of subsection A of this section and except in those instances where a lower maximum lawful speed is provided by this chapter it is unlawful for the operator of any vehicle to operate the same at a speed in excess of the following:

1. Twenty miles per hour:

a. In traversing any intersections where the driver’s view is obstructed. An operator’s view is deemed to be obstructed when at any time during the last 100 feet of his approach to an intersection he does not have a clear and uninterrupted view of such intersection, and of all streets entering such intersection for a distance of 100 feet along the centerline of each thereof;

b. In traveling upon an arterial highway in the city and traversing an intersection with another street not an arterial highway, and the operator of another vehicle about to enter the intersection of such arterial highway thereat has brought his vehicle to a complete stop as required by law before entering such arterial highway;

c. While traveling upon any street and proceeding through any business district, when such business district is so signposted at the extremities thereof;

d. When operating any vehicle upon the streets which have been designated and marked as school zones or public playgrounds between the hours of 8:00 a.m. and 5:00 p.m., or when crossing any marked school crossing during such hours;

2. Thirty-five miles per hour on Railroad Street between Hawthorne Avenue and Fifth Avenue;

3. From 395/Main Street and Third Avenue/SR 20 Junction to milepost 355.12 is 25 miles per hour. Twenty-five miles per hour under all other circumstances.

C. Compliance with such speeds under the circumstances set forth in this section shall not relieve the operator of any vehicle from the further exercise of due care and caution as further circumstances shall require.

D. The unlawful operation of a vehicle in excess of the maximum lawful speeds provided in this section at the point of operation and under the circumstances described shall be prima facie evidence of the operation of a motor vehicle in a reckless manner by the operator thereof.

E. All charges for the violation of any of the provisions of this section, every notice to appear, and every complaint charging the violation of this section shall specify approximately the speed at which the defendant is alleged to have operated such vehicle, the maximum lawful speed at the point of operation and the reasonable and proper rate of speed applicable under the conditions at the point of operation. 10.08.020 Traffic speed zones – Parks.

It shall be unlawful to operate a motor vehicle in any speed in excess of 20 miles per hour on the following streets and avenues in the corporate city limits adjacent to parks:

A. Angus McDonald Park.

1. On Main Street between Seventh Avenue and Eighth Avenue;

2. On Eighth Avenue between Main Street and Oak Street;

3. On Oak Street between Seventh Avenue and Eighth Avenue;

4. On Seventh Avenue between Main Street and Oak Street.

B. Yep Kanum Park.

1. On Dominion Avenue between Elm Street and Walnut Street;

2. On Walnut Street between Dominion Avenue and Hawthorne Avenue;

3. On Elm Street between Dominion Avenue and Hawthorne Avenue;

4. On Hawthorne Avenue between Elm Street and Walnut Street. (Ord. 1304 NS § 1, 2003; prior code § 10.04.080).

10.08.022 Traffic speed zones – Schools.

It shall be unlawful to operate a motor vehicle in any speed in excess of 20 miles per hour where signs “When Children Are Present” are posted under “20 MPH” signs on the streets and avenues in the corporate city limits in the following school zones:

A. Astor Elementary School.

1. On Astor Avenue, between Cedar Street and Alder Street;

2. On Birch Avenue, between Cedar Street and Alder Street;

3. On Hofstetter Street, between First Avenue and Columbia Avenue;

4. On Jefferson Street, between Astor Avenue and Birch Avenue;

5. On Jefferson Street, between Birch Avenue and Columbia Avenue.

B. Fort Colville Elementary School.

1. On Garden Homes Drive, from a point 200 feet west of the intersection centerlines of Garden Homes Drive and Ivy Avenue to a point 300 feet east of the intersecting centerlines of Garden Homes Drive and Swede-Anderson Road;

2. On Ivy Avenue, between Garden Homes Drive and Chester Street;

3. On Crestview Drive, from the north boundary of Fort Colville Elementary School 300 feet north;

4. On Madison Street, from the north boundary of Fort Colville Elementary School 300 feet north;

5. On Rae Street, from the north boundary of Fort Colville Elementary School 300 feet north; and

6. On Summit Street, from the north boundary of Fort Colville Elementary School 300 feet north.

C. Hofstetter Elementary School.

1. On Sixth Avenue, between Cedar Street and Hofstetter Street;

2. On Seventh Avenue, between Cedar Street and the east city limits;

3. On Hofstetter Street, from 300 feet north of the north Hofstetter Elementary School boundary to Sixth Avenue;

4. On Jefferson Street, from 300 feet north of the north Hofstetter Elementary School boundary to Sixth Avenue;

5. On Alder Street, from 300 feet north of the north Hofstetter Elementary School boundary to Sixth Avenue;

6. On Pine Street, from 300 feet north of the north Hofstetter Elementary School boundary to Sixth Avenue;

7. On Madison Street, from 300 feet north of the north Hofstetter Elementary School boundary to 300 feet south of the south Hofstetter Elementary School boundary.

D. Colville Junior High School.

1. On Hawthorne Avenue, between Walnut Street and Jefferson Street;

2. On Cedar Street, between Glen Avenue and the south city limits;

3. On Hofstetter Street, between Glen Avenue and Hawthorne Avenue.

E. The lower panel of a “School Speed Limit 20 MPH” sign which reads “When Children Are Present” shall mean that the 20-mile-per-hour school speed limit is in force under any of the following conditions:

1. School children are occupying or walking within a marked crosswalk;

2. School children are waiting at the curb or on the shoulder of the roadway and are about to cross the roadway by way of a marked crosswalk;

3. School children are present or walking along the roadway, either on the adjacent sidewalk or, in the absence of sidewalks, on the shoulder within the posted school speed limit zone. (Ord. 1304 NS § 2, 2003; prior code § 10.04.080).

10.08.024 Traffic speed zones – Streets.

It shall be unlawful to operate a motor vehicle in any speed in excess of 20 miles per hour on the following streets:

A. On Fairway Loop within the Fairway Addition.

B. On Elm Street between Hawthorne Avenue and Juniper Avenue. (Ord. 1383 NS § 1, 2007; Ord. 1304 NS § 3, 2003; prior code § 10.04.080).

10.08.030 Arterials designated.

A. The following streets and portions thereof between the points named are designated arterial highways:

1. Main Street extending from the south boundary of the city to the north line of Eleventh Avenue;

2. Birch Street from the east line of Main Street to the east city limits;

3. Third Avenue from the east line of Main Street to the east city limits;

4. First Avenue from the west line of Main Street to the west city limits;

5. Hofstetter Street from the south line of Birch Avenue to the south line of Hawthorne Avenue;

6. Sixth Avenue from the east line of Main Street to the east line of Hofstetter Street;

7. Hofstetter Street from the north line of Sixth Avenue to the north line of Seventh Avenue;

8. Seventh Avenue from the west line of Hofstetter Street to the east city limits;

9. Hawthorne Avenue from the east line of State Highway No. 395, Main Street, to the east line of Minor Street;

10. Hofstetter Street from the north line of Birch Avenue to the south line of Third Avenue;

11. Eighth Avenue from the west line of Main Street to the west line of Wynne Street;

12. Wynne Street from the south line of Eighth Avenue to the north line of Ninth Avenue;

13. Ninth Avenue from the east line of Wynne Street to the west line of Washington Street;

14. Washington Street from the south line of Ninth Avenue to the north city limits;

15. Dominion Avenue from the east line of Main Street to the east line of Oak Street;

16. Oak Street from the south line of Dominion Avenue to the south line of Third Avenue.

B. All other streets within the city limits shall be known as access streets or collector streets. (Ord. 1037 NS § 1, 1991; prior code § 10.04.090).

10.08.040 Elm Street and Dominion Avenue.

All vehicles proceeding north or south on Elm Street shall come to full stop at the intersection of Elm Street and Dominion Avenue. (Prior code § 10.04.100).

10.08.050 Astor Street – Left turn onto Main Street.

It is unlawful to make a left-hand turn, when proceeding east on Astor Street, onto Main Street. (Prior code § 10.04.150).

10.08.060 Left turns from Main Street.

It is unlawful for any person driving a motor vehicle to make a left turn across the centerline of Main Street at the intersection of Main Street and Astor Street; or between the north line of Astor Street and the north line of Birch Street. The traffic engineer is authorized to have such areas so designated, signed and/or marked prohibiting such left turns. (Ord. 800 NS § 1, 1979).

10.08.070 Removal of disabled vehicles.

Whenever any vehicle becomes stalled, disabled or unable to move under its own power, on or in any public facility such as streets, roads or highways in the city, including tunnels, bridges or approaches thereto or sections thereof, and such occurrence has been deemed by the authority having jurisdiction as being a menace or obstruction to the safety of the general public, such authority shall have the power and is authorized to remove such disabled vehicle, by either private or governmental equipment and such vehicle removed shall be impounded and held until towing charges have been paid by the owner thereof, and the authority to designate such obstruction as a menace to the general public and order of the same removed, is vested in the police department. 10.08.080 U-turns.

A driver of any vehicle on any street or alley within the downtown area bordered by and including Hawthorne, Sixth, Wynne and Elm Streets, as well as any designated arterial within the city limits, shall not turn such vehicle on the same street or alley so as to proceed in the opposite direction. (Prior code § 10.04.200).

10.08.085 Engine compression brake device use.

A. It shall be unlawful for any person, other than a member of a municipal or other duly constituted fire department or district, to use motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or any unit or part thereof within the city limits.

B. Any person violating any of the provisions of this section shall be guilty of a civil infraction enforced by Chapter 1.10 CMC. (Ord. 1446 NS §§ 1, 2, 2010).

10.08.090 Unlawful speed as evidence of reckless driving.

The unlawful operation of a vehicle in excess of the maximum lawful speeds provided in this chapter at the point of operation and under circumstances described shall be prima facie evidence of the operation of a motor vehicle in a reckless manner by the operator thereof. (Prior code § 10.04.190).

10.08.100 Manual on Uniform Traffic Control Devices adopted.

The June 2001 Millennium Edition of the Manual on Uniform Traffic Control Devices (MUTCD), with updated revisions thereto, and as adopted by the Washington State Department of Transportation on January 9, 2003, by emergency rule and amended by Chapter 468-95 WAC, together with any subsequent amendments thereto, is hereby adopted by reference in its entirety.
