10.20.010 Definitions.
The following words and phrases when used in this chapter shall, for the purposes of this chapter, have the meanings respectively ascribed to them in this section:
(1) “Skateboard” means a foot board mounted upon wheels and is usually propelled by the user who sometimes stands, sits, kneels or lays upon the device while it is in motion.
(2) “Roller skate” means a pair of shoes mounted upon wheels and is most often propelled by the user in an upright, standing position or kneeling.
(3) “Coaster” means a foot board mounted upon two or more wheels and controlled by an upright steering handle. This device is propelled by the user in usually an upright position.
(4) “Bicycle” means a two-wheeled cycle propelled by pedals.
(5) “Tricycle” means a three-wheeled cycle propelled by pedals.
(6) “To operate in a negligent manner” means the operation of one or more of the above-described devices in such a manner as to endanger or be likely to endanger any person or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic control devices and failure to yield right-of-way to pedestrians and/or vehicular traffic.
(7) “Central business district,” for purpose of this chapter, means that portion of the town of Concrete (including the sidewalks and public right-of-way on both sides of the following streets), described as follows: Main Street, starting at the intersection with North Dillard Avenue, thence west to the intersection with “E” Avenue. This area is depicted upon the map attached to Ord. 432, as Exhibit “A.”
(8) “Electric-assisted bicycle” means a bicycle with two or three wheels, a saddle, fully operative pedals for human propulsion, and an electric motor. The electric-assisted bicycle’s electric motor must have a power output of no more than 750 watts. The electric-assisted bicycle must meet the requirements of one of the following three classifications:
(a) “Class 1 electric-assisted bicycle” means an electric-assisted bicycle in which the motor provides assistance only when the rider is pedaling and ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour;
(b) “Class 2 electric-assisted bicycle” means an electric-assisted bicycle in which the motor may be used exclusively to propel the bicycle and is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour; or
(c) “Class 3 electric-assisted bicycle” means an electric-assisted bicycle in which the motor provides assistance only when the rider is pedaling and ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour and is equipped with a speedometer. 10.20.020 Bicycles prohibited on central business district sidewalks.
It is unlawful for any person to use, ride, operate, play with or propel a bicycle upon or over any sidewalk in the central business district of the town of Concrete. [Ord. 856, 2023; Ord. 432 § 2, 1998]
10.20.025 Electric-assisted bicycles prohibited on sidewalks.
It is unlawful for any person to use, ride, operate, play with, or propel an electric-assisted bicycle upon or over any sidewalk in the town of Concrete except when there is no other safe option for the bikes to travel. [Ord. 856, 2023]
10.20.026 Electric-assisted bicycles – Traffic laws to be followed.
All operators of electric-assisted bicycles must be familiar with and follow all federal, state and local traffic laws. [Ord. 856, 2023]
10.20.030 Traffic regulations.
(1) Any person operating a bicycle, skateboard, roller skates, tricycle or a coaster shall obey the instructions of official traffic control signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer.
(2) No person under the age of 16 may operate a class 3 electric-assisted bicycle. No driver’s license is required for the operation of an electric-assisted bicycle.
(3) An individual shall not operate an electric-assisted bicycle on any trail specifically designated as nonmotorized. [Ord. 856, 2023; Ord. 432 § 3, 1998]
10.20.040 Speed.
No bicycle, skateboard, roller skates, tricycle or coaster shall be ridden in a negligent manner but shall be operated with reasonable regard for the safety of the operator and other persons. [Ord. 856, 2023; Ord. 432 § 4, 1998]
10.20.050 Prohibited areas.
It is unlawful for any person to use, operate, play with, propel or ride upon any skateboard, roller skates, tricycle or coaster upon any street, alley, sidewalk, park or public parking lots in the central business district of the town of Concrete. [Ord. 856, 2023; Ord. 432 § 5, 1998]
10.20.060 Exception.
Nothing in this chapter shall be interpreted as prohibiting the use of any self-help equipment of handicapped person. [Ord. 856, 2023; Ord. 432 § 6, 1998]
10.20.070 Violation – Penalty.
Any person violating any provision of this chapter shall be guilty of an infraction and shall be punished by the imposition of a monetary penalty of not more than $250.00. Further, the device ridden at the time of violation shall be subject to impound for a period of 10 days. [Ord. 856, 2023; Ord. 432 § 7, 1998]
