2.30.010 Created – Terms – Vacancies.

(1) Pursuant to the authority conferred by Chapter 35A.63 RCW, there is hereby created a town planning commission, consisting of up to five members who shall be appointed by the mayor and confirmed by the town council.

(2) The term of office of members shall be six years.

(3) Vacancies occurring otherwise than through the expiration of terms shall be filled for the unexpired terms. Members may be removed by the mayor with the approval of the town council for inefficiency, neglect of duty or malfeasance in office. (Ord. 785 § 1, 2020; Ord. 9 § 1, 1959)

2.30.020 Powers and duties.

The planning commission shall have all of the powers and perform each and all of the duties specified by said Chapter 44 of the Session Laws of 1935 of the state of Washington, together with any other duties or authority which may hereafter be conferred upon them by the laws of the state of Washington, the performance of such duties and the exercise of such authority to be subject to each and all the limitations expressed in such legislative enactment or enactments. 2.30.030 Town council referrals and recommendations.

The town council may refer to the planning commission, for its recommendation and report, any ordinance, resolution or other proposal relating to any of the matters and subjects referred to in said Chapter 44 of the 1935 Session Laws, and the commission shall promptly report to the council thereon, making such recommendations and giving such counsel as it may deem proper in the premises. 2.30.040 Plat and subdivision recommendations and reports – Building permit applications.

All plats or plans of subdivisions of land within the town or proposed additions, as well as dedications of streets and alleys, offered to the town council for acceptance shall first be submitted to the planning commission for its recommendation and report, which report shall be made to the council within 30 days after submission, or at such earlier date as the council shall direct. All applications for building permits shall be reviewed by the planning commission. (Ord. 9 § 4, 1959)

2.30.050 Secretary.

The planning commission may designate one of its members to act as secretary without salary, or if requested by the commission the mayor shall designate a member of the paid staff of the town to serve as such secretary, who shall serve without additional compensation. (Ord. 9 § 5, 1959)

2.30.060 Quorum.

The majority of the membership of the planning commission shall constitute a quorum for the transaction of business. Any action taken by a majority of those present, when those present constitute a quorum at any regular or special meeting of the planning commission, shall be deemed and taken as the action of the commission. (Ord. 9 § 6, 1959)

2.30.070 Yearly report – Contents.

The planning commission, at or before its first regular meeting in February of each year, shall make a full report in writing to the town council of its transactions and expenditures if any, for the preceding year, with such general recommendations as to matters covered by its prescribed duties and authority as may to it seem proper. (Ord. 9 § 7, 1959)

2.30.080 Board of appeals.

The planning commission shall act as the “board of appeals” for purposes of conducting an investigation and rendering findings and decisions concerning the interpretation of the building code and the suitability of alternate materials and methods of construction under the Uniform Building Code, and the commission shall adopt reasonable rules and regulations for conducting its business as a “building code board of appeals.” (Ord. 394 § 1, 1991)
