DISTURBING THE PEACE

9.25.010 Prohibited acts.

The following are determined to disturb the public peace:

(1) The frequent, repetitive or continuous sounding of any horn, siren, except as a warning of danger or as specifically permitted or required by law;

(2) The creation of frequent, repetitive or continuous sounds in connection with the starting, operation, repair, rebuilding, or testing of any motor vehicle, motorcycle, off-highway vehicle, watercraft, or internal combustion engine within a residential district, so as to unreasonably disturb or interfere with the peace, comfort and repose of owners or possessors of real property, unless otherwise authorized by law;

(3) The creation of frequent, repetitive or continuous sounds which emanate from any building, structure, apartment, or condominium, which unreasonably interfere with the peace, comfort, and repose of owners or possessors of real property, such as sounds from audio equipment, musical instruments, band sessions, or social gatherings;

(4) Sound from motor vehicle sound systems, such as tape players, radios, and compact disc players, or boom boxes, operated at a volume so as to be audible greater than 50 feet from the vehicle itself;

(5) Sound from audio equipment, such as tape players, radios, compact disc, boom box, operated at a volume so as to be audible greater than 30 feet from the source, unless it occurs within a multifamily unit such as duplex, apartment or condominium, in which case it shall be a disturbance if it is audible to a neighbor, and disturbs his/her peace as described in subsection (4) of this section;

(6) Yelling, shouting, whistling, singing, or other raucous noises, on or near the public streets between the hours of 11:00 p.m. to 7:00 a.m. or at any time and place as to unreasonably disturb or interfere with the peace and comfort of owners or possessors of real property. (Ord. 504 § 1, 1998)

9.25.020 Jake/compression brakes.

The use of compression brakes within the town limits is prohibited.

Exception: SR 155 (northbound only) from the south town limits to Stevens Ave. (Ord. 684 § 1, 2010; Ord. 504 § 1, 1998)

9.25.030 Exemption.

The foregoing provisions shall not apply to regularly scheduled events such as public address systems, authorized dances or other authorized community sponsored events. Safety devices, fire alarms and emergency vehicles are exempt from the provisions of this chapter. (Ord. 504 § 1, 1998)

9.25.040 Violation – Penalty.

A violation of this chapter shall be deemed a criminal act and any person, firm, or corporation found guilty of such conduct is subject to a fine not to exceed $300.00 for each offense, and in addition to such imposition of penalty, anyone violating this chapter shall be liable for all costs of damage and injury proximately caused by the violation. Each day or part thereof that a violation of this chapter continues shall be deemed as a separate offense. (Ord. 504 § 3, 1998)
