12.20.020 Vehicle and/or trailer removal during snow plowing.

The Davenport city foreman, or his designee, has authority to require vehicles and/or trailers to be moved from city right-of-way to facilitate snow plowing. Whenever the vehicles and/or trailers as required by the Davenport city foreman, or his designee, to facilitate snow plowing are not moved as required, the city foreman, or his designee, is authorized to provide for the removal of such vehicles and/or trailers. Any costs incurred in the removal, keeping or storage shall be paid by the owner of the vehicle so removed, and the same shall be a lien upon such vehicle. (Ord. 964 § 1, 2006).

12.20.030 No parking – Restricted parking.

(a) There shall be no parking allowed on Morgan Street year round from 2:00 a.m. to 6:00 a.m. Parking is not allowed from December 1st to March 1st one block north and south of Morgan Street on Fifth, Sixth and Seventh from 2:00 a.m. to 6:00 a.m. Parking is not allowed on the west side of Harker Street from December 1st to March 1st from 2:00 a.m. to 6:00 a.m.

(b) No parking shall be allowed year round and at any time during the day or night along both the easterly and westerly sides of Third from Morgan Street north to the southern edge of Ross Street.

(c) To increase the protection of the multi-modal delineated traffic along McInnis Road, there shall be no parking allowed year round and at any time during the day or night along McInnis’ northbound lane’s easterly and southern edge from Davenport city limits to Davenport city limits.

(d) Parallel parking shall be required year round during the day or night along the right-of-way and any curbline and/or sidewalk, if so installed, located on both the easterly and westerly sides of Tenth Street from Morgan Street (SR2) north to the southern edge of the alley between SR2/Morgan and Logan Street.

(e) Penalty. Anyone found in violation of this chapter is subject to a civil infraction and if found guilty subject to the general penalties designated in Chapter 1.04 DMC. The first offense shall be subject to a fine of $150.00 plus state assessments, second offense by the same vehicle is subject to a $300.00 fine, plus state assessments, as well as provisions for the third, fourth and subsequent violations as outlined in DMC 1.04.010, General penalties.

If the vehicle found parked in the ROW is determined to be an obstruction to traffic the responding law enforcement officer may have the vehicle towed at the owner’s expense. (Ord. 1139 §§ 1, 2, 2019; Ord. 1067 § 1, 2012; Ord. 690 § 1, 1991; Ord. 529 § 2, 1980).

12.20.040 Vehicle removal – Lien.

Whenever any police officer finds any vehicle unattended upon Morgan Street, or one block north and south of Morgan Street on Harker, Fifth, Sixth, and Seventh Streets, which is unlawfully parked in any prohibited or restricted area, such officer is authorized to provide for the removal of such vehicle to the nearest place of safety. Any cost incurred in the removal, keeping or storage shall be paid by the owner of the vehicle so removed, and the same shall be a lien upon such vehicle. (Ord. 529 § 2, 1980).

12.20.050 Private lots – Removal by city.

Snow removed from private lots shall be removed by the city without notice to property owners if the snow constitutes a hazard to traffic, and the property owner shall be billed and shall pay at the current hourly rate for labor and equipment. Property owners may contact the city to remove snow that has been plowed from private property; however, it shall be removed at the city’s convenience and billed and paid by the property owner at the current hourly rate for labor and equipment.
