1.16.010 General penalty – Misdemeanors and gross misdemeanors.
A. Unless otherwise specifically provided in this code for a specific violation of a criminal law provided for in this code or adopted by reference by provisions of this code, any person convicted of a gross misdemeanor shall, upon conviction, be subject to fines and/or imprisonment as set forth in RCW 9A.20.021, as the same exists now or may hereafter be amended.
B. Unless otherwise specifically provided in this code for a specific violation of a criminal law provided for in this code or adopted by reference by provisions of this code, any person convicted of a misdemeanor shall, upon conviction, be subject to fines and/or imprisonment as set forth in RCW 9A.20.021, as the same exists now or may hereafter be amended. 1.16.020 General penalty – Civil infractions.
Unless otherwise specifically provided in this code or other ordinances of the city, any person violating any mandatory requirements of this code or any ordinance of the city that is designated therein as a civil infraction or for which no penalty is specifically stated shall be deemed guilty of a civil infraction; provided, that no such offense is designated as a crime in the Revised Code of Washington. The burden of proof applicable to enforcement of civil infractions is a preponderance of the evidence. Civil infractions are noncriminal offenses for which imprisonment or incarceration may not be imposed as a sanction and the punishment for a civil infraction shall be a monetary penalty, which monetary penalty shall not exceed $500.00. 1.16.030 State law consistency.
In the event any provision of this code or any ordinance of the city addresses conduct or actions which are also a crime as set forth in the Revised Code of Washington (“RCW”), the penalty provision set forth in the RCW shall be controlling if the corresponding code provision or ordinance provides for a penalty which is different from the RCW, as mandated by RCW 35.21.163, as the same exists now or may hereafter be amended.
