10.06.010 Definitions.
The following words and phrases when used in this chapter shall, for the purposes of this chapter, have the meanings respectively ascribed to them in this section:
“Skateboard” means a footboard mounted upon four or more wheels and is usually propelled by the user who sometimes stands, sits, kneels or lays upon the device while it is in motion.
“Roller and in-line skates” means a pair of shoes mounted upon wheels or blade type devices and is most often propelled by the user in an upright, standing position or kneeling.
“Coaster” means a footboard mounted upon two or more wheels and controlled by an upright steering handle. The user is usually in an upright position to propel this device.
“To operate in a negligent manner” means the operation of one or more of the above-described devices in such a manner as to endanger or be likely to endanger any person or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic control devices and failure to yield right-of-way to pedestrians and/or vehicular traffic. 10.06.020 Traffic laws apply to operator.
Any person operating a bicycle, skateboard, roller and in-line skates, or a coaster shall obey the instructions of official traffic control signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer. (Ord. 744(b) § 4, 2000; Ord. 720 § 2, 1998)
10.06.025 Hand signals.
All hand signals required of persons operating bicycles shall be given in the following manner:
A. Left turn: Left hand and arm extended horizontally beyond the side of the bicycle;
B. Right turn: Left hand and arm extended upward beyond the side of the bicycle, or right hand arm extended horizontally to the right side of the bicycle.
C. Stop or decrease speed: Left hand and arm extended downward beyond the side of the bicycle.
The hand signals required by this section shall be given before initiation of a turn. (Ord. 720 § 2, 1998)
10.06.030 Riding and parking.
A. A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto.
B. No bicycle shall be used to carry more persons at one time than the number for which it is designated and equipped.
C. No person shall ride a bicycle upon a sidewalk in a business district.
D. A person may ride a bicycle on any other sidewalk or any roadway unless restricted or prohibited by traffic control devices.
E. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian.
F. No person shall park a bicycle upon a highway other than off the roadway except in designated areas, upon the sidewalk in a rack to support the bicycle, against a building, or in such manner as to afford the least obstruction to pedestrian traffic. (Ord. 720 § 2, 1998)
10.06.035 Use on roadways and bicycle paths.
A. Every person operating a bicycle upon a roadway at a rate of speed less than the normal flow of traffic at the particular time and place shall ride as near to the right side of the right through lane as is safe; except as may be appropriate while preparing to make or while making turning movements, or while overtaking and passing another bicycle or vehicle proceeding in the same direction. A person operating a bicycle upon a roadway or highway other than a limited-access highway, which roadway or highway carries traffic in one direction only and has two or more marked traffic lanes, may ride as near to the left side of the left through lane as is safe. A person operating a bicycle upon a roadway may use the shoulder of the roadway or any specially designated bicycle lane if such exists.
B. Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles.
C. No bicycle, skateboard, roller and in-line skates or coaster shall be ridden in a negligent manner but shall be operated with reasonable regard for the safety of the operation and other persons. (Ord. 744(b) § 5, 2000; Ord. 720 § 2, 1998)
10.06.040 Wheelchair conveyances.
A. No person may operate a wheelchair conveyance on any public roadway with a posted speed limit in excess of 35 miles per hour.
B. No person other than a wheelchair bound person may operate a wheelchair conveyance on a public roadway.
C. Every wheelchair-bound person operating a wheelchair conveyance upon a roadway is granted all the rights and is subject to all the duties applicable to the driver of a vehicle by this chapter, except those provisions that by their nature can have no application.
D. A violation of this section is a traffic infraction. (Ord. 720 § 2, 1998)
10.06.050 Mopeds – Safety standards.
Mopeds shall comply with those federal motor vehicle safety standards established under the National Traffic Vehicle Safety Act of 1966 which are applicable to a motor-driven cycle, as that term is defined in such federal standards. (Ord. 720 § 2, 1998)
10.06.060 Clinging to vehicles.
No person riding upon any bicycle, coaster, roller skates, sled or toy vehicle shall attach the same or himself to any vehicle upon a roadway. (Ord. 720 § 2, 1998)
10.06.065 Prohibited areas.
A. It is unlawful for any person to operate or ride upon any roller and in-line skates, coasters, or skateboards upon any street, or sidewalk in the central business district of the city of Deer Park. It is unlawful for any person to operate or ride upon any roller, in-line skates, coaster, or skateboard on any publicly owned property with the exception of the city parks.
B. The central business district as referred to in this section applies to Crawford Street from Stevens to Railroad Avenue; south Main from “A” Street to Second Avenue on north Main; and First Avenue from Vernon to Railroad Avenue. (Ord. 746 § 1, 2000; Ord. 744(b) § 6, 2000)
10.06.070 Carrying articles.
No person operating a bicycle shall carry any package, bundle or article which prevents the driver from keeping at least one hand upon the handlebars. (Ord. 720 § 2, 1998)
10.06.080 Lamps and other equipment on bicycles.
A. Every bicycle when in use during the hours of darkness as defined in RCW 46.37.020 shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front. The rear equipment shall include a red reflector of a type approved by the state patrol that shall be visible from all distances from 100 feet to 600 feet to the rear when directly in front of lawful lower beams of headlamps on a motor vehicle. A lamp emitting a red light vis-ible from a distance of 500 feet to the rear may be used in addition to the red reflector.
B. Every bicycle shall be equipped with a brake, which will enable the operator to make the braked wheels skid on dry, level, and clean pavement. (Ord. 720 § 2, 1998)
10.06.090 Unclaimed bicycles.
All unclaimed bicycles in the custody of the police department shall be disposed of as provided in Chapter 63.32 RCW. (Ord. 720 § 2, 1998)
10.06.095 Violation – Penalty – Severability.
A. Any person violating any provision of this chapter shall be guilty of an infraction and shall be punished by the imposition of monetary penalties as follows:
1. First offense: $50.00;
2. Second offense: $100.00;
3. Third offense, and each consecutive offense: $150.00.
Further, the devices shall be subject to impound for a period of 10 days at the time of violation.
B. If any section, subsection, sentence, clause, phrase, or portion of this chapter is for any reason declared or held to be invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate and distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
