9.32.010 Purpose—Limitations.

This chapter is enacted to define areas within the county where the discharge of firearms should be restricted in order to protect people, domestic animals and property from inadvertent injury and damages. Nothing in this chapter shall be construed to abridge the right to bear arms guaranteed by Article I, Section 24 of the Washington State Constitution. (Ord. CE 06-02-73B Exh. A (part): Ord. 9.32.020 Definitions.

The following definitions shall apply to the interpretation and enforcement of this chapter:

A.    “Firearm” means any weapon or device designed to expel a projectile. The term “firearm” shall include but not be limited to rifles, pistols and shotguns. The term “firearm” shall not include tools used in the construction or building trade when used for such purpose. The term “firearm” shall not include equipment used by agriculture to protect crops when used for such purpose.

B.    “Ordinary high water mark” means that mark on all lakes and streams which will be found by examining the bed and banks in ascertaining where the presence and action of waters are so common and usual and so long continued in all ordinary years as to mark upon the soil a characteristic distinct from that of the abutting upland.

C.    “Person” means an individual, firm, partnership, corporation or association.

D.    “Shoreline” means the border between a body of water and land measured by the ordinary high water mark. (Ord. CE 06-02-73B Exh. A (part): Ord. CE 06-01-36B Exh. A (part))

9.32.030 Discharge of firearms prohibited.

A.    No person shall discharge any firearm in that area between the county’s boundary line at the midline of the Columbia River to fifty feet easterly of the paved edge of the Apple Capital Loop Trail and from the Odabashian Bridge (US 2/97) on the north and the George Sellar Bridge (SR 285) on the south.

B.    All portions of the following named Rock Island Ponds lying outside the city limits of the City of Rock Island and lying at or below the Rock Island Project Vertical Datum elevation of 620, and fifty feet from the water mark’s edge, located within the following sections:

1.    Blue Heron Lake: NW 1/4 Section 26, Township 22N, Range 21 EWM.

2.    Big Bow Lake: SE 1/4 Section 23, Township 22N, Range 21 EWM.

3.    Hideaway Lake: SW 1/4 Section 24, Township 22N, Range 21 EWM.

9.32.050 Exceptions to prohibition.

The prohibitions contained in this chapter shall not apply to the following persons and circumstances:

A.    Any person acting in lawful self-defense or lawful defense of others;

B.    Law enforcement, National Guard or United States military personnel while engaged in performance of duties. (Ord. CE 06-02-73B Exh. A (part): Ord. CE 06-01-36B Exh. A (part))

9.32.100 Violation—Penalty.

9.32.110 Severability.

If any provision of this chapter or its application to any person or circumstance is held invalid, the remainder of this chapter or the application of the provisions to other persons or circumstances shall not be affected. (Ord. CE 06-02-73B Exh. A (part): Ord. CE 06-01-36B Exh. A (part))
