15.98.240 Board of appeals—Designation, authority, and procedures.
A. The Douglas County hearing examiner is hereby designated as the Douglas County Building Code board of appeals.
B. The board of appeals has the authority to determine the suitability of alternate materials and methods of construction or fire safety protection, and to provide for reasonable interpretations of the IBC, IRC, IFC and this title: provided, that the board of appeals does not have the authority to interpret the administrative provisions of this code or those codes referenced in DCC Chapter 15.12, nor shall the board of appeals have the authority to waive the requirements of this code or the codes referenced in DCC Chapter 15.12. The board of appeals has broad authority and discretion to impose conditions determined necessary to implement the purposes of this title.
C. Appeals to the board of appeals shall comply with DCC Section 14.12.010. All appeals to the board of appeals shall be open record appeals. Decisions of the board of appeals shall be in writing and filed with the building official and served on the appellant(s) and respondent(s), if any. The board of appeals may adopt rules and procedures for conducting appeal proceedings. There shall be no administrative appeal of a decision of the board of appeals and such decision shall be final and conclusive unless appealed to the superior court in accordance with DCC Section 14.12.020.
