MARIJUANA-RELATED USES PROHIBITED

25.127.010 Marijuana-related uses prohibited.
The city of DuPont hereby prohibits the establishment, location, operation, licensing, maintenance or continuation of medical marijuana collective gardens and other establishments involved in the retailing, producing or processing of recreational marijuana within the city of DuPont. (Ord. 14-968 § 1)
25.127.020 Severability.
Should any section, paragraph, sentence, clause or phrase of this chapter, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this chapter be preempted by state or federal law or regulation, such decision or preemption shall not affect the validity of the remaining portions of this chapter or its application to other persons or circumstances. 25.127.030 Moratorium terminated.
The 12-month moratorium established pursuant to Ordinance 13-957 shall terminate upon the effective date of the ordinance codified in this chapter. (Ord. 14-968 § 3)
25.127.040 No nonconforming uses.
No use that constitutes or purports to be a medical marijuana collective garden, marijuana producer, marijuana processor, or marijuana retailer that was engaged in that activity prior to the enactment of the ordinance codified in this chapter shall be deemed to have been a legally established use under the provisions of the DuPont Municipal Code and that use shall not be entitled to claim legal nonconforming status.
