TEMPORARY USE

25.155.030 Decisional criteria.
25.155.010 Purpose.
The purpose of this chapter is to provide a process to consider and grant permits for temporary uses as defined in DMC 25.10.210. (Ord. 07-854 § 1; Ord. 02-707 § 1)
25.155.020 Procedure.
A temporary use shall be processed as a Type I procedure as set forth in DMC 25.175.010 with a filing fee per DMC 2.03.010. A single one-year extension may be granted for only construction trailers if the primary development project that necessitates the temporary use is not completed within the one-year time period. 25.155.030 Decisional criteria.
(1) All of the following decisional criteria must be met in order for the application to be approved:
(a) The use is consistent with the comprehensive plan;
(b) The use is consistent with the allowed uses in the district in which the property is located;
(c) The use complies with applicable health and safety requirements of the district in which the property is located; and
(d) The use complies with all other applicable criteria and standards of the DMC.
(2) Conditions of Approval. The city may condition the application in order to insure conformance with provisions of the above decisional criteria.
(3) Removal. The subject site shall be returned to its predevelopment state within 30 days of cessation of the temporary use as required by the approval. Additionally, a construction office for which a temporary use permit has been granted shall be removed from the subject site when the related construction is completed or the last unit is completed by the contractor.
(4) Assurance Device. The decision maker may, in his/her sole discretion, require that the applicant for the temporary use post a bond, in the form and by a surety acceptable to the city attorney, and in an amount estimated by the city, to cover the cost of removal of the temporary use and restoration of the property.
