There is established a planning commission, consisting of seven members who shall serve without compensation and be selected as follows:
A. All members shall be appointed by the mayor. All appointments and reappointments to a position shall be made in writing by the mayor.
B. At the time of appointment and throughout their first term of office, each member of the planning commission shall reside within the city or in Douglas County within three miles of the city limits of the city, own property within the city, or do business in the city. Any member who ceases to qualify as a member of the planning commission under this subsection during his/her term of office shall forfeit the office.
C. The initial term shall be staggered, positions l, 2, and 3 shall be appointed for terms expiring December 31, 1988; positions 4 and 5 shall be appointed for terms expiring December 31, 1989; and positions 6 and 7 shall be appointed for terms expiring December 31, 1991. Following the initial term, each member of the planning commission shall serve for two years, except as otherwise provided in this chapter.
D. Vacancies occurring other than through the expiration of terms shall be filled for the unexpired terms of the position number vacated. (Ord. 90-6 § 1, 1990; Ord. 88-10 § 1, 1988; Ord. 88-1 § 1, 1988)
2.30.020 Powers and duties.
A. Generally. The planning commission shall have all powers and perform all duties specified for the planning agency in Chapter 35A.63 RCW, as the same now exists or is hereafter amended, together with any other duties or authorities which may be conferred upon them by the laws of the state or the ordinances of the city; provided, that nothing in this chapter shall be construed as limiting the right of the city to exercise any power granted to any class of city as provided by law.
B. Rules of Procedure. The planning commission may adopt rules of procedure for the conduct of meetings and other functions delegated to the planning commission by the city council; provided, that the rules of procedure adopted are in accordance with state law and city ordinances. The rules of procedure need not be approved by the city council.
C. Prior Actions of the Planning Commission. All previous actions of and business transacted by and/or under the auspices of or on behalf of or in the capacity of the planning commission are ratified and approved by the city council. (Ord. 88-1 § 1, 1988)
2.30.030 Report to council – Transactions.
The planning commission, on or before its first regular meeting in February of each year, shall make a full report in writing to the city council of its transactions and expenditures, if any, for the preceding year, with such general recommendations as to the matters covered by its prescribed duties and authority as may to it seem proper. 2.30.040 Meetings.
The planning commission meets on the fourth Wednesday of each month at 5:30 p.m. in the City Hall. If a regular meeting date falls upon a city holiday, the meeting shall be conducted on the next regular business day unless a special meeting date is set in advance. All meetings, both regular and special, are subject to the State Open Public Meetings Act, Chapter 42.30 RCW (as enacted or as amended). 2.30.050 Quorum.
A majority of the membership of the planning commission shall constitute a quorum for the transaction of business. Unless otherwise specified by state law or city ordinance, (i) a quorum shall be required for the transaction of any business of the planning commission, and (ii) in actions requiring a vote of the planning commission a favorable vote of the majority shall be required for approval of all motions. Any action taken at a regular or special meeting of the planning commission shall be deemed and taken as an action of the commission. (Ord. 88-1 § 1, 1988)
2.30.060 Designation of secretary.
The community development director of the city or his/her designated representative shall act as the planning commission secretary. The planning commission secretary shall prepare written minutes of the planning commission and present the same for approval of the planning commission at the next regular meeting of the planning commission. The planning commission secretary shall prepare proposed written findings and conclusions of the planning commission when required and shall present the same to the city council after they have been adopted by the planning commission.
