DONATION ACCEPTANCE PROCEDURE

There is hereby established a special account, to be designated the “donations to Enumclaw account.” The purpose of this account is to provide for the deposit and financial administration, including project accounting, of monetary donations to the city and the expenditure and proper use thereof. (Ord. 2766 § 2, 2023).
3.70.020 Administration by finance department.
The finance department shall have the responsibility of the financial administration of the account and shall maintain separate records of accounts showing receipts and disbursements for all donations and for all projects assigned to the account. The department may also establish rules and regulations for the administration of the account. (Ord. 2766 § 3, 2023).
3.70.030 Deposit.
All donations accepted by the city shall be deposited in the account. If a donation is made to any program with a previously established fund for the collection of monetary donations, any donation made to that program(s) shall be deposited into the appropriate fund. (Ord. 2766 § 4, 2023).
3.70.040 Use of funds.
In the event the donor indicates a mere desire as to the use by the city of a donation, such donation shall, to the extent reasonably feasible, be assigned to a project consistent with the donor’s desired use. If not designated, such funds shall be deposited as unreserved, undesignated general fund monies. In the event the donor places mandatory requirements upon the use of the donation, in accordance with the acceptance authority below, the city may reject any and all donations if the required use of the funds cannot reasonably be achieved, or if the city will incur costs greater than $500.00 per year to administer the donation. 3.70.050 Acceptance authority.
A. Monetary Donations. The city administrator or designee shall have the authority to accept all monetary donations with a current value less than $1,000. The finance committee shall have the authority to accept all monetary donations with a current value greater than $1,000 and less than $5,000 during a properly noticed regular or special committee meeting. The city council shall have the authority to accept and approve all monetary donations with a value of $5,000 or greater by motion or resolution during a properly noticed regular or special council meeting.
B. Nonmonetary Donations. Department directors and the city administrator may approve in-kind donations supporting budgeted projects, regardless of the value of the nonmonetary donation. The department accepting the donation may be required to detail all related future costs and/or obligations associated with the acceptance of the donation and submit the list of expenses to the approving authority with the donation request. The city administrator may accept all nonmonetary donations of any other kind, regardless of value, including but not limited to equipment and goods, but may reject the nonmonetary donation for any reason.
