8.16.010 Created.

There is created a department or division of municipal government to be known as the “sanitation utility.” The department is placed under the general supervision and direction of the commissioner of public works. (Prior code § 10.54.010)

8.16.020 Function and purpose.

It is the purpose of the sanitation utility to provide for the construction, operation, and maintenance of all necessary and desirable refuse disposal sites, to collect fees for the depositing of refuse material at such municipal disposal sites, and to engage in the municipal collection of refuse and waste material within the city and/or to take all necessary and desirable steps to supervise or collect, transmit, treat and dispose of refuse and waste material which is generated as a result of any occupancy or use of land by residents of the city. 8.16.030 Superintendent—Qualification and appointment.

The superintendent of the sanitation utility shall be a person experienced in the management and operation of garbage collection and disposal systems, and while such person need not be a licensed civil engineer, such superintendent shall possess such background and experience in the operation of all necessary equipment used or to be used by the city in the collection and disposal of refuse and waste material. The superintendent shall be under the direction and control of the commissioner of public works. The superintendent shall be nominated by the commissioner of public works, and such nomination shall be approved by the majority of the Everett city council. Said superintendent shall have under his management and control, subject to the commissioner of public works as aforesaid, the management, maintenance and operation of any sanitary waste disposal site or facility, and shall have general supervision of the collection of refuse within the city, and the management and control of any municipal operation in the area of refuse collection, or the enforcement of any ordinance or regulation dealing with commercial collectors of refuse acting within the city. 8.16.040 Sanitation utility fund.

There is created a special fund of the city to be known as the “sanitation utility fund.” Any and all charges and revenues received for the use of the garbage or refuse disposal site as set forth herein or as may hereafter be set forth by ordinances or regulations of the city shall be deposited in said fund. Further, any and all collection charges collected by the city from residents or persons within the city, which represent charges for the collection of garbage, waste or refuse material, shall be deposited in said fund and credited thereto. In general, any and all charges or revenues received by the city having to do with the collection, transportation, storage or disposal of garbage, refuse or waste material, shall be credited to and paid into such fund. All operation expenses incurred by the city in the operation of a disposal site, all engineering expenses incurred by the engineering department, or any other department of the city in the planning, designing, supervising, and administering of any work in connection with a disposal site or collection of refuse material, and all expenses of maintenance and operation of the garbage utility, including but not limited to, all improvements, additions, betterments, extensions, repairs, replacements, except when the same are financed by the issuance of bonds, and amounts required to pay and secure the payment of principal and interest upon sanitation utility or garbage revenue bonds and coupon warrants, shall be paid out of the fund.
