SOLID WASTE MANAGEMENT UTILITY1

14.44.010 Created—Powers.

The city of Everett solid waste management utility shall continue and is authorized to undertake all activities authorized by law for the construction of the landfill and tire fire site improvement projects, and for garbage and solid waste handling including recycling operations and specifically including mitigation of the old landfill property on 36th Street east of the I-5 freeway; provided, that said utility is not authorized to engage directly in garbage and solid waste collection, except for hard-to-manage waste and/or city-wide clean-up projects and programs as the mayor deems necessary to promote and facilitate waste reduction, recycling and disposal. 14.44.020 Mayor to supervise.

The solid waste management utility shall be under the direct management of the mayor using such staff and consultant services as the mayor deems appropriate. The mayor is authorized to contract, as necessary, pursuant to state law, for solid waste management services and clean-up or mitigation activities. Any permanent city staff proposed for the solid waste management utility shall be identified in the personnel ordinance. (Ord. 3094-08 § 2, 2008)

14.44.030 Budget.

The annual budget for the solid waste management utility shall be as established in Fund 402. (Ord. 3094-08 § 3, 2008)

14.44.040 Rates and charges—Effective January 1, 2009.

Effective January 1, 2009, rates and charges for the solid waste management utility shall be as follows:

14.44.050 Rates and charges—Effective January 1, 2010.

Effective January 1, 2010, rates and charges for the solid waste management utility shall be as follows:

14.44.060 Disabled and senior citizen rates.

Rates and charges for the solid waste management utility shall be subject to reduction for low-income senior and low-income disabled citizens as provided in Section 14.04.025 or as such may be amended. (Ord. 3094-08 § 6, 2008)

14.44.070 City council review.

Rates will be subject to review by city council at such time as outstanding debt has been retired. (Ord. 3094-08 § 7, 2008)

14.44.080 Mayor to establish rules and regulations.

The mayor is authorized to establish reasonable rules, regulations and procedures in connection with collection of rates and charges for the city of Everett solid waste management utility. (Ord. 3094-08 § 8, 2008)
