PROCEDURES FOR CERTAIN LEGISLATIVE LAND USE ACTIONS

15.32.010 Legislative actions—Plans and regulations.

A.    The following planning commission and city council legislative decisions include the adoption or amendment of all or any element of the following:

1.    Comprehensive plan or comprehensive plan map;

2.    Subarea plan;

3.    Planned action ordinance or resolution;

4.    Area rezone in conjunction with a comprehensive plan change;

5.    Planned development or other overlay zone;

6.    Development regulation or other code revisions, including revisions to the zoning code text;

7.    Adoption of institutional overlay zone that is of area-wide significance or general applicability; and

8.    Any other legislative action identified in the zoning code as Review Process V.

B.    Public Notice. Notice of proposed actions under this section, including comprehensive plan, zoning code text changes, and development regulations or revisions, shall be provided by:

1.    Mailing to all persons who have made written request to be notified of the proposed change;

2.    Mailing to the SEPA mailing list if applicable;

3.    Mailing to the neighborhood leader mailing list if applicable; and

4.    Publishing notice in the official city newspaper.

C.    Action Taken. The city council and planning commission shall be deemed to be acting in their legislative capacity in taking any of the above actions. If an action is a project permit rather than of area-wide significance or general applicability, the action shall be considered quasi-judicial in nature and shall be processed under Review Process VA.

In reviewing the recommendation of the planning commission, the city council shall have the authority to approve, disapprove or modify the proposal in whole or in part, or remand the proposal in its entirety or the portions of the proposal about which it has concerns to the planning commission for further consideration. A final SEPA determination and document, which may be combined or otherwise integrated with the proposed action, shall be provided to the planning commission and to city council prior to their respective actions.
