16.06.010 Regulations for Barrier-Free Facilities adopted by reference.

The Regulations for Barrier-Free Facilities as promulgated by the state of Washington Building Code Advisory Council amended October 1, 1976, April 18, 1979, November 18, 1988 and as amended in this chapter is adopted and enacted by reference as though fully set forth at length in this chapter. 16.06.020 Section 002 amended—Purpose.

Section 002 of the Regulations for Barrier-Free Facilities as promulgated by the Washington State Building Code Advisory Council is amended to read as follows:

Purpose

Section 002. It is expressly the purpose of this Code to provide for and promote the health, safety and welfare of the general public, and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this Code.

It is the specific intent of this Code that no provision nor any term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the implementation or enforcement of this Code shall be discretionary and not mandatory.

Nothing contained in this Code is intended to be nor shall be construed to create or form the basis for any liability on the part of the City, or its officers, employees or agents, for any injury or damage resulting from the failure of a building to comply with the provisions of this Code, or by reason or in consequence of any inspection, notice, order, certificate, permission or approval authorized or issued or done in connection with the implementation or enforcement of this Code, or by reason of any action or inaction on the part of the City related in any manner to the enforcement of this Code by its officers, employees or agents.

16.06.030 Section 20.3 added—Violations and penalties.

There is added the following section to the Washington State Regulations for Barrier-Free Facilities:

Violation and Penalties

20.3 Any person, firm or corporation violating any provision of this Regulation shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a fine not to exceed FIVE HUNDRED dollars ($500) or by imprisonment in jail not to exceed six (6) months, or both fine and imprisonment. Each separate day or any portion thereof, during which any violation of this Regulation occurs or continues, shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for or an approval of, any violation of any of the provisions of this Regulation. No permit presuming to give authority to violate or cancel the provisions of this Regulation shall be valid, except insofar as the work or use which it authorized is lawful.
