16.48.010 Dispensing devices.
Approved special dispensing devices incorporating a remote console from which the attendant shall have full control over any and all pumps designated as self-service are permitted at service stations within the city, provided there is at least one qualified attendant on duty while the station is open to the public. The attendant shall be required to actuate an individual control switch from the control console authorizing dispensing from each self-service pump prior to the delivery of any gasoline. Further, the console shall provide a control device for emergency cutoff of all dispensing should need arise. The attendant’s primary function shall be to supervise, observe and control the dispensing of Class I liquids as defined in the city fire prevention code, while the liquids are being dispensed. It shall be the responsibility of the attendant to prevent the dispensing of Class I liquids into portable containers not in compliance with the city fire prevention code, control sources of ignition, and to immediately handle accidental spills and fire extinguishers if needed. 16.48.020 Attendant requirements.
The attendant or supervisor on duty shall be capable of performing the functions and the responsibilities outlined in this chapter. (Prior code § 7.24.020)
16.48.030 Emergency and dispensing controls.
Emergency and dispensing controls shall be an integral part of any self-service system installed at a location acceptable to the city fire marshal, but controls shall not be more than one hundred feet from dispensers. (Prior code § 7.24.030)
16.48.040 Instructions.
Instructions for the operation of dispensers shall be conspicuously posted. (Prior code § 7.24.040)
16.48.050 Nozzle valves.
All nozzle valves utilized in a self-service system shall be a listed automatic-closing type without a hold-open latch. (Prior code § 7.24.050)
16.48.051 Card lock fuel dispensing.
Card lock or key-type dispensing mechanisms for Class I and Class II liquids, and liquefied petroleum gases shall be authorized so long as they are dispensed by a qualified attendant for service stations which are not open to the public and for which the mechanism is used only by commercial, industrial, governmental or manufacturing establishments for fueling vehicles used in connection with their businesses, provided that the owner of such station is accountable for the safe operation of the station and the training of the users thereof. Such stations may include card or key operated dispensers. Each service station operating a card or key operated dispenser shall provide the city with a letter signed by a duly authorized representative of the service station indicating the name of the commercial, industrial, governmental or manufacturing establishment authorized to use the card or key operated dispenser, and the name of the individual employed by the establishment trained to operate the dispensing mechanism. Such letter shall also indicate the date or dates on which the individual was trained in the use of the dispenser. (Ord. 1172-85 § 1, 1985; Ord. 172-71 § 8, 1971)
16.48.052 Fire protection mechanisms.
A. All vehicles for which fuel is dispensed from a card lock or key-type operated dispenser shall keep in the vehicle at least one fire protection mechanism and/or fire extinguisher in good operating condition acceptable to the city fire marshal. Such fire protection shall include at least one fire extinguisher with a 2A-20 BC rating or better.
B. All service stations utilizing card lock or key-type fuel dispensing mechanisms shall have at least one fire extinguisher with a 2A-20 BC rating or better available at each island where card lock or key-type dispensing mechanisms are operated. (Ord. 1172-85 § 2, 1985; Ord. 172-71 § 9, 1971)
16.48.053 Sales of fuels from card lock or key-type dispensing mechanisms.
All card lock and key-type fuel metering and computing devices shall:
A. Display the price per gallon or price per liter; provided, that if motor fuel is offered for sale by the liter, the price per liter must be clearly displayed on the dispenser directly adjacent to the corresponding price per gallon, with the information appearing in contrasting letters of at least two inches in height;
B. Indicate the amount of fuel delivered during a single transaction;
C. Register the selling price per unit;
D. Register the total selling price for a single transaction;
E. Compute the price per gallon or liter as set forth in National Bureau of Standards Handbook 44. [Order No. 1794, effective May 11, 1983] (Ord. 1172-85 § 3, 1985; Ord. 172-71 § 10, 1971)
16.48.054 Equipment testing.
In accordance with Section 9.70.100 of this code, access for weights and measures testing of the equipment must be available within twenty-four hours of request by the city sealer. Each service station operating a card or key operated dispenser or pump shall provide the city sealer with a letter indicating the name and phone number of a company contact person. 16.48.055 Printed delivery ticket for card lock systems.
On each delivery of fuel there shall be rendered to the purchaser, at the time of delivery, a delivery ticket or a written statement on which, in ink or by means of other indelible marking equipment and, in clarity, equal to type or printing, there shall be clearly stated: (1) the name and address of the vendor, (2) the name of the purchaser, (3) the identity of the type of fuel comprising the delivery, (4) the unit price per gallon or liter of the fuel delivered, and (5) the liquid volume of the delivery, together with any meter readings from which such liquid volume has been computed, expressed in terms of the gallon or liter and its binary or decimal subdivision. 16.48.056 Emergency shut-off switch—Contact person for service.
All service stations utilizing card lock or key-type fuel dispensing mechanisms shall have within thirty to fifty feet from the dispensing mechanism an emergency shut-off switch which is at all times readily accessible and identifiable to the operator of the dispensing mechanism. All such devices shall also have adequate information detailing the method of reporting complaints or equipment malfunctions. This information shall include the name, address and phone number of the local servicing agency for the device and be conspicuously displayed on each service island. 16.48.060 Penalty for violations.
Any person who violates or fails to comply with any provision of this chapter is guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than three hundred dollars, or by imprisonment of not more than thirty days. (Prior code § 7.24.060)
