16.56.050 Penalty for violations.
16.56.010 Electric fences.
No person shall erect, alter, extend or maintain any fence, wire or structure within the city limits of Everett through which an electric current shall pass for the purpose of creating and imparting an electric shock to persons or animals that may come into contact with the same; except as allowed by Section 19.39.070(F). Any electric fence erected or maintained shall be energized by battery power only, or by some other method as allowed by the building official, and fence controllers shall be approved by a nationally recognized testing lab and so indicated. An “electric fence” warning sign shall be posted at not more than fifty-foot intervals. (Ord. 3600-18 § 3, 2018: prior code § 2.40.010)
16.56.020 Barbed wire fences.
No person shall erect or maintain any fence, within the city limits of Everett, that is composed of, or has any part of, constructed of barbed wire unless such fence is located within an area zoned A-1 Agricultural Use Zone as set forth in the zoning code of the city of Everett, or unless such barbed wire is placed above a woven wire or solid wooden fence, said fence to be of a minimum height of six feet, for the purposes of providing an impenetrable barrier for use around industrial properties, athletic fields, airports, electric substations, storage yards, etc., or unless such fence encloses a minimum land of twenty-two thousand square feet solely devoted to the pasturing and/or sheltering of animals permitted by ordinance. 16.56.030 Permits required.
A building and/or electrical permit shall be obtained, from the building department, prior to erection or re-erection of any fence. (Prior code § 2.40.030)
16.56.040 Enforcement.
The chief of police and/or his duly authorized representative shall be the enforcing officer of this chapter. (Prior code § 2.40.050)
16.56.050 Penalty for violations.
Any person, persons, companies or corporations violating any of the provisions of this chapter by maintaining or erecting a barbed wire or electric fence within the city, as set forth in this chapter shall upon conviction be punished by a fine of not to exceed five hundred dollars or imprisonment for a period not to exceed six months or by both fine and imprisonment.
