10.09.010 Weight limits – Imposition by Traffic Engineer – Types.

The following weight restrictions may be placed by the Everson Traffic Engineer under authority of WAC 308-330-265:

A. Permanent weight restrictions, consisting of weight restrictions based on street classification.

B. Temporary weight restrictions, consisting of temporary weight restrictions on streets of any classification based on the condition of the affected roadbed pending repair or reconstruction.

C. Emergency weigh restrictions, consisting of temporary weight restrictions on streets of any classification based on flooding, freezing, thawing, or other climactic conditions that temporarily affect the load-bearing capacity of the affected street. [Ord. 549 § 1, 1998.]

10.09.020 Weight limits – Vehicle exemptions by category – Speed limit.

A. Permanent or temporary weight restrictions imposed by the Traffic Engineer shall not prohibit the operation of school buses, emergency vehicles, utility repair vehicles, heating fuel supply vehicles and solid waste/recycling collection vehicles; provided, that the speed limit for such nonemergency vehicles travel shall be 20 miles per hour.

B. Emergency weight restrictions imposed by the Traffic Engineer shall not prohibit the operation of emergency vehicles, utility repair vehicles or heating fuel supply vehicles; provided, that the speed limit for nonemergency vehicles shall be 10 miles per hour. [Ord. 549 § 1, 1998.]

10.09.030 Weight limits – Vehicle exemptions by special permit – Application – Fees.

The Mayor, or the Mayor’s designee, is hereby authorized to issue special single day permits as an exception to the weight restrictions imposed pursuant to EMC 10.08.010 upon such weight, speed or route restrictions as the Mayor finds reasonable and necessary to permit passage yet reduce or prevent damage to City streets. Application for single day weight restriction exemptions shall be made on such forms as the Mayor may prescribe and shall be accompanied by a fee of $[nil] for each single day permit. 10.09.040 Weight limits – Violations – Penalties.

Any violation of weight limits imposed pursuant to this chapter shall be a traffic infraction with a base penalty of $100.00. [Ord. 549 § 1, 1998.]
