The Hearings Examiner of the City of Ferndale shall act as the Board of Appeals. (Ord. 1724 § 1, 2012)
2.25.020 Authority, powers and duties.
A. The Board of Appeals shall have the final authority on cases brought before them, unless the Board’s decision is appealed to Whatcom County Superior Court within 21 days of a written decision pursuant to FMC 14.11.080(A).
B. The Board of Appeals shall hear administrative decisions or interpretations rendered by the Building Official or their designee related to construction and building methods proposed to the City, but shall not hear appeal of decisions unless related to construction standards.
1. Every appeal by the applicant or property owner to the Board of Appeals of an administrative interpretation or administrative permit decision shall be filed in writing with the Community Development Director within 10 calendar days from the date of the interpretation or decision regarding the matter being appealed.
2. The notice of appeal shall contain a concise statement reflecting the requirements of FMC 14.11.070(C).
C. The Board of Appeals shall hear the matter(s) before them, keep a record of proceedings, consider facts, and issue a written determination. (Ord. 1724 § 1, 2012)
2.25.050 Rules and meetings.
The Board may establish rules for transaction of its business. The meetings and other sessions of each Board shall be open to the public in accordance with the provisions of Chapter 42.30 RCW. (Ord. 1724 § 1, 2012)
