5.12.010 Definitions.

“Public dance hall” is defined for the purpose of this chapter, to be any building, room, hall, platform, or other place which is kept or used for public dances at frequent intervals, or in which, for compensation paid, directly or indirectly, to the owner, manager or operator thereof, men and women are permitted to engage in dancing. A “public dance” is defined for the purposes of this chapter to be any dance held in such public dance hall, for which money or other thing of value is paid directly, or indirectly, to the person or organization holding the dance, for the privilege of attending the same. 5.12.020 Intoxicated or disorderly persons prohibited.

It is unlawful for any person, association, firm or corporation maintaining, conducting or carrying on any public dance hall, or having charge or control thereof, or for any person employed in and about the same, to allow or permit any person under the influence of intoxicating liquors, or any boisterous or disorderly person, to enter, be, or remain in, or dance in, any such public dance hall. 5.12.030 Intoxicating liquor prohibited.

A.    It is unlawful for any person, association, firm or corporation conducting public dance halls, or public dances, or for any person having charge or control thereof, at any time when a dance is being conducted, to permit any person to bring into the dance halls or any room or rooms in connection therewith, or upon the premises upon which such dance hall is situated, any intoxicating liquor, or to permit intoxicating liquors to be drunk in the dance hall, in any rooms, or upon the premises.

B.    The provisions of this section shall have no application to premises licensed for cabaret dancing as provided in Chapter 5.08 FMC. (Ord. 382 § 9, 1963; Ord. 360 § 4, 1960)

5.12.040 Lighting.

It is unlawful to operate a public dance hall or public dance with less light than five footcandles 30 inches above the floor over the entire interior public area or outside dancing area. (Ord. 360 § 5, 1960)

5.12.050 Right of access for police.

It is unlawful for any proprietor, manager, his or their agents, servants, or employees of such public dance hall or dance to refuse to allow any member of the police force, in line of duty, free access to such hall or public dance. (Ord. 360 § 6, 1960)

5.12.060 Posting of ordinance.

The proprietor or manager of such public dance hall shall display in a prominent place in such dance hall a copy of the ordinance codified in this chapter. (Ord. 360 § 7, 1960)

5.12.070 Violation – Penalty.

Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than $10.00 or not to exceed $100.00, or by imprisonment for a period not exceeding 30 days. (Ord. 360 § 9, 1960)
